Resolution No.(95): “Ruling on Zakat-ul-Fitr“

Resolution No.(95) by the Board of Iftaa`, Research and Islamic Studies:

     "Ruling on Zakat-ul-Fitr“    

Date: 9/9/1426 AH, corresponding to 12/10/2005.

 

 

Question:

What is the ruling on Zakat-ul-Fitr ?

Answer: All success is due to Allah.

Zakat-ul-Fitr is the Zakat due in Ramadan on every Muslim who can afford to give it, whether young or old, male or female. Ibn Umar narrated: “Allah's Apostle enjoined the payment of one Sa' of dates or one Sa' of barley as Zakat-ul-Fitr on every Muslim slave or free, male or female, young or old, and he ordered that it be paid before the people went out to offer the 'Id prayer. (One Sa' = 3 Kilograms approx).”{Bukhari}.

It has been enjoined for what is mentioned in the following Hadith: Ibn ’Abbas (RAA) narrated: "The Messenger of Allah (PBUH) enjoined Zakat-ul-fitr on the one who fasts (i.e. fasted during the month of Ramadan) to purify him from any indecent act or speech and for the purpose of providing food for the needy. It is accepted as Zakah for the person who pays it before the Eid prayer and it is Sadaqah (i.e. voluntary charity) for the person who pays it after the Eid prayer." [Related by Abu Dawud and Ibn Majah and Al-Hakim graded it as Sahih].

A Muslim is obliged to give for himself and on behalf of those whom he is obliged to provide for: wife, children,  his Muslim servants, and his baby who is born before the Eid prayer.

Zakat-ul-Fitr is one Sa' of dates or one Sa' of barley or the like from the regular food of the people of that country.

A Muslim is free to choose from these items in accordance with his financial capability, and it is permissible to give the monetary value of the Sa`, so as to facilitate for Muslims and do what is best for the poor. The monetary value of the Sa` of each item is estimated by the circulated price of that item. In the Hashemite Kingdom of Jordan, the regular food is wheat; therefore, the monetary value of Zakat-ul-Fitr for the year (2005) was estimated at six hundred and fifty fils as a minimum, and whoever gives more Allah will multiply his reward.

Its due time is after the sunset of Eid night and before the Eid prayer. This is based on the Hadith narrated by Ibn Umar: “The Prophet ordered the people to pay Zakat-ul-Fitr before going to the 'Id prayer." {Bukhari}. However, it is permissible to give it during Ramadan to facilitate for the poor. And Allah knows best.

I`m married to an American citizen who used to be married to a man in Mexico and filed for divorce there. It is worth pointing that in America she isn`t registered as married. When she arrived in Jordan, her lawyer called and told her that she got the divorce, and based on this we got married in Jordan. What is the ruling of Sharia on this?

You haven`t mentioned whether this woman has converted to Islam or not. If she had embraced Islam and three menstrual cycles passed, but her first husband hasn`t converted to Islam, then her relationship with him is over. If you married her after this (Passing of three menstrual cycles and first husband not having embraced Islam) then your marriage is valid. However, if she didn`t convert to Islam then your marriage contract with her is invalid and you have to wait until she gets divorced by her first husband and observes Iddah, which is three menstrual cycles. Afterwards, you can conclude the marriage contract. We pray that Allah doesn`t hold you to account for what you have done because you thought she was divorced. We recommend that you seek Allah`s forgiveness as much as you can and do righteous deeds. We also advise you to marry a Muslim woman to preserve your and your children`s religion since Almighty Allah Says (What means): "Wed not idolatresses till they believe…" [Al-Baqarah/ 221]. It is true that marrying a Kitabi (One who believes in a book of sacred scriptures and with whom a Muslim may marry in what is deemed a lawful marriage) is permissible, it involves great risks, as stated in the aforementioned verse. And Allah The Almighty Knows Best.
 

What`s the ruling on using the following materials in manufacturing cosmetics: olive oil, Vaseline, talc powder, glycerin, honey, almond oil, pine oil, galingale and marjoram?

All perfect praise be to Allah, The Lord of The Worlds, and may His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.                                                                                                                                                                                                                                    None of the above materials is forbidden, and it`s lawful to use them in manufacturing products that are beneficial to people. This is because, in principle, all things are lawful so long as there is no evidence in Sharia indicating otherwise. And Allah Knows Best.

 Is Hyena's Meat Permissible or Impermissible?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.
There is disagreement amongst the jurists as regards the ruling on eating hyena`s meat. Shafi`i and Hanabli jurists are of the view that eating hyena`s meat is permissible. The proof is the Hadith related by Al-Baihaqhi on the authority of Ibn Abi Ammar who said: "I asked Jabir bin Abdulla about hyenas, and he told me to eat them. I said: "Is it not game? He said: 'Yes' I said: 'Did you hear that from the Messenger of Allah?" He said: "Yes."  And Allah The Almighty Knows Best.

I am pregnant with four twins since two months although I didn't have childbearing potential during the last four years. In addition, the doctor specialized in reprusccusions, already has notified me about the possible reprusccusions as a result of being pregnant with four twins as follows: abortion, Metrorrhagia, Premature birth, high blood pressure, gestational diabetes and the like. What is the ruling on aborting some of the aforementioned embryos? A medical report was attached in which the status of my question is clarified.

If the existence of the four embryos leads to critical reprusccusions/or threat on mother's health, life or a possibility of aborting all of them, then aborting one/two/three is permissible mitigate the above mentioned risks so long as the ages of the embryos don't exceed four months. And Allah Knows Best.
