Resolution No.(86): “Ruling on the Revenue Obtained from Investing Al-Husseini Mosque`s Lavatory“

Resolution No.(86) by the Board of Iftaa`, Research and Islamic Studies:

“Ruling on the Revenue Obtained from Investing  Al-Husseini Mosque`s Lavatory“

Date: 26/2/1426 AH, corresponding to 6/4/2005 AD.

 

 

 

Question: What is the ruling of Sharia on the revenue obtained from investing Al-Husseini Mosque`s lavatory; should it be given to the Awqaf Funds Development Foundation, or spent on the mosque`s maintenance, needs and various projects?

Answer: All success is due to Allah.

The Board is of the view that the objective of the Awqaf Funds Development Foundation is to develop the Awqaf {endowments} funds as stipulated in the Awqaf`s law, and not to take their revenues, even if it had made the investment, because the yield must be spent in accordance with the terms of the endowers and the nature of the endowment itself. Therefore, the Board deems that the revenue obtained from investing the above lavatory should be dedicated to Al-Husseini Mosque and to be spent on its maintenance, needs and various projects. And Allah The Almighty Knows Best.

Is it permissible to swear by (Allah "The Living")?

Yes, it is permissible because "The Living" is one of Allah`s Attributes.

Is it permissible for a financially capable woman to pay the Zakat to her sons or one of them?

It is permissible for a mother to give her children from zakat if they are eligible to receive it, even though she is obligated to provide for them. This is based on the saying of the Prophet Muhammad (PBUH) regarding Zainab, the wife of Abdullah Ibn Mas'ud (may Allah be pleased with them): "Your husband and your children are more deserving of your charity" [Al-Bukhari]. Is it incumbent on a family to provide for its old handicapped son and take care of him?

The family and relatives - e.g. brothers - of such a person are obliged to spend on him and take care of him if he didn`t have money of his own.

What is the ruling on reciting the Chapter after Al-Faatihah , and what should a worshiper who forgets it do?

All perfect praise be to Allah, The Lord of The Worlds.                                                                                                                                                                  Any other part of Qur'an that a worshiper reads after Al-Faatihah during the first and the second Rak`ahs is a Sunnah, and forgetting to do so doesn`t nullify prayer, and doesn`t require performing Sujood As-Sahw (prostration of forgetfulness). And Allah Knows Best.
