Resolution No.(81): “The Ruling of Sharia on Printing Two Copies of the Quran“

Date Added : 28-10-2015

Resolution No.(81) by the Board of Iftaa`, Research and Islamic Studies:

"The Ruling of Sharia on Printing Two Copies of the Quran“

Date: 9/7/1425 AH, corresponding to 25/8/2004 AD.

Question:

I have attached two copies of the Quran, and would like to know whether printing them is permissible or not?

First copy: Printed by Dar Al-Kahir, Beiruit, size 35/25 cm, 4th edition 1402, and includes a marginal index on each page of the Mus-haf.

Second copy: Memorization Mus-haf written on cards that hold Tafseer Al-Jalalain, first edition 2004 AD.

Answer: All perfect praise be to Allah.

The Board is of the view that the marginal index in the first copy usually leads to concealing the marks indicating the Quran`s parts, Ahzaab, Arbaa`, pauses and instances of prostration. The Board sees that such a copy of the Mus-haf is lawful so long as it preserves the marks which indicate the above mentioned.

As regards the second copy, the Board has the following remarks:

1- This copy changes the order of the Quran`s chapters as  revealed from Allah The Almighty.

2- Writing the Mus-haf on cards eliminates the marks indicating its parts, Ahzaab, Arbaa`, pauses and instances of prostration.

3- Placing Tafseer {science of explaining the meaning of the Quran} Al-Jalalain behind these cards contradicts with the practice observed by Al-Salaf Al-Saleh {righteous predecessors} who kept the interpretation on the margins.

4- There are many methods for memorizing the Quran other than the cards method.

Therefore, the Board bans printing the second copy. And Allah Knows Best.

Summarized Fatawaa

What is the wisdom behind legislating the Udhiyah?

The Muslim must know that through the Uḍḥiyah, he complies with the command of Allah, the Exalted, and performs a worship that brings him closer to Allah and distances him from the Fire.

The Uḍḥiyah holds profound wisdoms and noble meanings, including:

1-Reviving the Sunnah of Abraham, peace be upon him: He complied with Allah's command when He ordered him to slaughter his son Ishmael. Abraham, peace be upon him, succeeded in the test, and when he was about to slaughter his son, Allah sent down a ram to ransom Ishmael and commanded him to slaughter it instead. Allah, the Exalted, says {what means]: "And when he reached with him [the age of] exertion, he said, 'O my son, indeed I have seen in a dream that I [must] sacrifice you, so see what you think.' He said, 'O my father, do as you are commanded. You will find me, if Allah wills, of the steadfast.' And when they had both submitted and he put him down upon his forehead, We called to him, 'O Abraham, You have fulfilled the vision.' Indeed, We thus reward the doers of good. Indeed, this was the clear trial. And We ransomed him with a great sacrifice." [Al-Ṣāffāt/102-107]. Thus, the sacrificial offering became an enduring Sunnah until the Day of Judgment, and Muslims offer their wealth as sacrifices, drawing closer to Allah, the Exalted, reviving this great Sunnah.

2-Providing abundance for people on Eid day and the Days of Tashrīq: Among the wisdoms of the Uḍḥiyah is that the Muslim provides generously for his family, neighbors, relatives, and the poor during these days. The Muslim is encouraged to eat from his sacrifice, give charity from it to the poor, and gift from it to his wealthy neighbors. Thus, goodness spreads throughout the entire community. The Prophet, peace and blessings be upon him, said: "The Days of Tashrīq are days of eating and drinking." (Narrated by Muslim). Allah, the Exalted, says {what means}: "And the camels and cattle We have appointed for you as among the symbols of Allah; for you therein is good." [Al-Ḥajj/36]. This good includes the good of both this world and the Hereafter.

Is Zakah (obligatory charity) due on articles of merchandise even if they were stacked in the merchant`s stores for years?

Yes, Zakah is due on goods even if they were stacked in merchant`s stores for years, in this manner Islam struggle against monopoly.

Should a prayer performer who forgets to offer the middle Tashahod (saying ash-hadu anala ilaha ila-alah) offer Sujood As-Sahw (prostration of forgetfulness)?

He/she should offer two prostrations of forgetfulness at the end of the prayer. And Allah Knows Best.

What is the ruling of Islamic Law on obtaining financing from Islamic banks by bringing invoices in prior arrangement with the seller, then taking the cash after the financing is approved — with the purpose of settling debts and buying a car?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.
It appears from the transaction described that its underlying purpose is to obtain cash through resorting to a legal artifice (ḥīlah/tawarruq-style trick), and it is not permissible to engage in such trickery or to coordinate with the various parties merely to obtain liquidity. This is because such artifices bring the sale closer in reality to a ribā-based (usurious) transaction, even if it outwardly appears otherwise.
The Prophet ﷺ said: "Do not commit what the Jews committed, thereby making lawful what Allah has made unlawful through the flimsiest of tricks." This was related by Ibn Baṭṭah in his book Ibṭāl al-Ḥiyal (p. 47), and many scholars have graded it as ḥasan (sound/acceptable).
We have already explained the impermissibility of engaging in such deceptive dealings with Islamic banks in Fatwa No. 516, so please refer to it. And Allah, the Exalted, knows best.
