Resolution No.(67): "Ruling on Dividing Land in Accordance with Tameem Ad-Dari`s Endowment"

Date: 23/5/1424 AH corresponding to 23/7/2003 AD.

 

The Board received the following question:

How to divide an inherited plot of land {Waqf Tameem Ad-Dari type} amongst eligible heirs, taking into consideration that it is located within the borders of Al-Khalil Municipality. Is it possible to divide it according to Sharia, or the Ottoman Land Code?

Answer: All success is due to Allah.

After deliberation, the Board is of the view that the revenue of the aforementioned plot and the structure on it is to be divided according to Sharia, and not the Ottoman Land Code. This is because it isn`t a miri land stated in the Ottoman Land Code, rather, it is registered as an endowment of Tameem Ad-Dari`s type, located within the borders of Al-Khalil Municipality. Is it permissible to pay the Fitr Zakah (obligatory charity) of Ramadan on behalf of a dead person?

The Fitr Zakah of Ramadhaan isn`t due on one who had passed away before the sunset of the last day of Ramadan. And Allah Knows Best.

Is it permissible to trim the eyebrows if they become excessively long?

Trimming eyebrows is permissible if they become excessively long, yet; it is reprehensible. And Allah Knows Best.

What is the Ruling on Reciting the Prophetic Narration?

 All Perfect Praise be to Allah, The Lord of The Worlds, and may His Peace and Blessings be upon our Prophet Muhammad and upon all of his family and companions.
Reciting the Prophetic narration is permissible as many scholars used to, since in principle, the rulings of recitation have to be observed while speaking Arabic language. And Allah Knows Best.

Is it permissible to say: "O Allah, by the status of the saints and the righteous, and our master Muhammad, peace be upon him, grant us the ability to reach Ramadan"?

What is mentiond by the righteous predecessors that they used to say: "O Allah bless us in Shaba'an and Rajab and give us the ability to reach Ramadan." [Shoa'ab Al-Iman/vol.3/pp.375]. And Allah Knows Best.
