Resolution No.(182)(15/2012) by the Board of Iftaa`, Research and Islamic Studies:

"Ruling on Linking the Rent with a Changing Parameter"

Date: 23/12/1433 AH, corresponding to 8/11/2012 AD.

All perfect praise be to Allah, The Lord of The Worlds, and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

On the above given date, the Board reviewed  linking the rent with a changing parameter.

After researching and deliberating, the Board decided what follows:

Linking rents with changing parameters is one of the modern forms employed by markets to overcome the fluctuation of prices; particularly, long term rents where prices of apartments vary and values differ in accordance with the factors affecting the market.

Therefore, the Board sees no harm in linking the rent with a specific parameter by which the contracting parties are governed when determining the amount of the rent at the beginning of long term leases, because it averts dispute and deception.

Since Muslim scholars have permitted hiring a worker in return for food and clothing, hiring a reaper in return for a fixed amount of the crop as well as selling and leasing according to the market price, or the standard price, then it is axiomatic that it is permissible to lease items (apartments, cars...etc.) against a rent which is linked with a certain financial parameter. I want to buy a house by having a loan from a bank?

If taking a loan from usrious banks it is impermissible; on the other hand, if this took place through Islamic ones then it is permissible to get the loan, since Allah the Most Exalted Said (What means): "And Allah has made buying lawful and forbidden usury (riba)." And Allah Knows Best.

 

 

 

Is it permissible for a father to disinherit his disobedient, alcohol consuming son and his daughter who had fled home and never returned?

It is permissible to give heirs some money because of their being extra obedient or needy. As far as inheritance is concerned, it is to be divided after one`s death, so it had better be left to the court itself. And Allah The Almighty Knows Best.

A man who was on travel prayed Duhr as four Rakhas upon leaving Tafilah heading to Amman. However, on his way to Amman, he prayed Asir as two Rakhas (Shortened). Is what he did correct from an Islamic perspective?

What he did is correct; he is liable for nothing before Allah The Almighty, since combining and shortening prayers during travel are two separate concessions. Therefore, it is permissible for a traveler to shorten prayer without combining it with another. And Allah The Almighty Knows Best.

I`m a married young man. I fell in love with a widow and proposed to her but her family refused because they feared that this would have an adverse impact on the future of her children. However, we entered into unregistered marriage and told my family and even my wife about it. I`m a person who fears Allah, The Almighty and want to clear myself from any liability before Him, The Exalted. What should I do?

It is imperative that you proclaim this marriage to preserve rights. Therefore, you must register it in an Islamic court. A second marriage isn`t forbidden, however, if the unregistered marriage had taken place without the consent of the woman`s guardian nor the presence of two honorable witnesses, then it is considered void and your relationship with this woman is forbidden. Therefore, you must conclude a new marriage contract with the approval of her guardian and the presence of two honorable witnesses. We advise you to fear Allah and adhere to the teachings of Sharia in this regard since sinful conduct is that which turns in your heart (making you feel uncomfortable) and you dislike that it would be disclosed to other people.
