Resolution No.(67): "Ruling on Dividing Land in Accordance with Tameem Ad-Dari`s Endowment"

Date: 23/5/1424 AH corresponding to 23/7/2003 AD.

 

The Board received the following question:

How to divide an inherited plot of land {Waqf Tameem Ad-Dari type} amongst eligible heirs, taking into consideration that it is located within the borders of Al-Khalil Municipality. Is it possible to divide it according to Sharia, or the Ottoman Land Code?

Answer: All success is due to Allah.

After deliberation, the Board is of the view that the revenue of the aforementioned plot and the structure on it is to be divided according to Sharia, and not the Ottoman Land Code. This is because it isn`t a miri land stated in the Ottoman Land Code, rather, it is registered as an endowment of Tameem Ad-Dari`s type, located within the borders of Al-Khalil Municipality. My mother is 70 years old and wishes to perform Hajj and Umrah, as she has never done so before. However, she also takes care of my ill father and is afraid of falling ill herself. What should she do?
 
 
 
 
 
 

If this is the obligatory Hajj – meaning she has not previously performed Hajj or Umrah – then it is permissible for her to go even without her husband's approval. However, she must travel with a Mahram (a male guardian) or a trustworthy group of women, and she should leave someone to care for her husband and attend to his needs.  Is it permissible for a Muslim woman to uncover her hair in the presence of a Christian woman?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.
According to the reliable opinion of the Shafie School of Thought, this isn`t permissible. However, some scholars stated that it is permissible for a woman to uncover what she usually uncovers while doing housework, but this differs from one place to another where some women uncover their hair while some don`t. However, this is provided that a woman doesn`t uncover her hair in the presence of non-Mahram men (Men permissible for a woman to marry). And Allah The Almighty Knows Best.

Is it permissible for a Muslim physician to specialize in gynecology obstetrics, and what is the ruling on working as such?

Some fields of knowledge are an individual duty while others are a collective one, and specializing in gynecology obstetrics is a collective duty. However, if there were female physicians to treat women, then there is no need for a male gynecology obstetrics specialist to look at women`s Awrahs (private parts) except in necessary situations since the jurisprudential maxim says:” Necessity must only be assessed and answered proportionately.” And Allah Knows Best.

It is stated in the Noble Quran that pork is forbidden for Muslims. Why is that so?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.
To Allah belongs the dominion of the heavens and the earth and He makes certain things allowed for us, while others are declared prohibited. Consequently, He the Almighty wouldn`t make something prohibited unless it is harmful;  whether we are made acquainted with the reason or not. Moreover, medical doctors have stated that there are many harms for pork. And Allah The Almighty Knows Best.
