Resolution No.(67): "Ruling on Dividing Land in Accordance with Tameem Ad-Dari`s Endowment"

Date: 23/5/1424 AH corresponding to 23/7/2003 AD.

 

The Board received the following question:

How to divide an inherited plot of land {Waqf Tameem Ad-Dari type} amongst eligible heirs, taking into consideration that it is located within the borders of Al-Khalil Municipality. Is it possible to divide it according to Sharia, or the Ottoman Land Code?

Answer: All success is due to Allah.

After deliberation, the Board is of the view that the revenue of the aforementioned plot and the structure on it is to be divided according to Sharia, and not the Ottoman Land Code. This is because it isn`t a miri land stated in the Ottoman Land Code, rather, it is registered as an endowment of Tameem Ad-Dari`s type, located within the borders of Al-Khalil Municipality. Is it permissible for a person who broke fasting in Ramadan because of being sick to pay a ransom?

If there is hope for him/her to be cured, then he would be required to make up for the missed fasting days when he/she recovers, and no ransom is due on him/her. If his/her disease is incurable, then he/she would be required to pay a ransom for each missed fasting day, which is (600) grams of wheat, or rice. And Allah Knows Best.

If the imam does not leave time for reciting Surah Al-Fatihah, is the recitation of Al-Fatihah waived for the follower?

The recitation of Al-Fatihah is not waived for the follower. They should recite it silently, even if it causes a slight delay in following the imam in bowing (Ruku'). And Allah Knows Best.

I am an author, and I have books stored with me. Is it permissible to pay my zakat in the form of books containing beneficial knowledge for poor students, such as chemistry and mathematics, or religious books that spread Islamic sciences?

Zakat on wealth must be paid in cash from the wealth itself. Therefore, you should pay your zakat in monetary form so that the poor can purchase what they need. And Allah Knows Best.

 

 

 

What is the Time for Making up Fajr Prayer and Other Missed Ones?

The Messenger of Allah (PBUH) said: "Whoever forgets a prayer, let him perform it when he remembers it." [Muslim]. As soon as you (Questioner) wake up, you are obliged to make up the missed Fajr prayer. And Allah Knows Best.
