Resolution No.(315), By The Board of Iftaa', Researches and Islamic Studies:

"Ruling on Pre-Slaughter Electrical Stunning of Birds"

Date (27 of Thilgidah, 1443 AH), corresponding to (27/6/2022 AD).

Praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions

In its ninth meeting held on the above date, the Board of Iftaa` reviewed the resolution of the joint commission in charge of examining the use of electrical stunning of birds (Poultry) before slaughter in local slaughterhouses.

After thorough deliberations, the Board decided what follows:

Slaughtering an animal in accordance with Islamic Law is the condition that makes an animal`s meat lawful to eat and distinguishes it from dead animal, as reflected in the following verse (What means): "unless ye are able to slaughter it (in due form)." {Al-Ma`idah, 3}. Moreover, the Prophet (PBUH) said: "As long as it causes blood to flow, and Allah's Name has been mentioned over it, then eat it." {Agreed upon}. When jugular veins, food tract and windpipe of the animal whose life is stable are cut, its meat is lawful to eat, whether the slaughtering was done with or without the electrical stunning. What counts is that the stunning doesn`t lead to killing the animal on the spot or later, in case it was left without slaughtering, since the purpose behind the stunning is to relieve that animal and facilitate the slaughtering process. In order to achieve this purpose, the Board is of the view that using the electrical stunning based on the afore-stated conditions is permissible according to Islamic Law. The Board also considers that it is essential to implement the Jordan Standard Specification No.2060/214 issued by the Jordan Standards and Metrology Organization (JSMO) to guarantee the implementation of all the general requirements of the sanitary and safety standards of the product.

Given the difficulty of implementing technical requirements or specific standards on all the local slaughterhouses, due to their using different machines and production lines, the Board is of the view that the management of each slaughterhouse should submit an individual application to the (JSMO). This concerns its production line and in the event it uses electrical waterbath stunning of poultry before manual slaughtering by knife. In fact, this enables a special commission from the Iftaa` Department to participate with specialized technicians to arrive at a special Fatwa regarding the method used by the applicant slaughterhouse. The Fatwa will either permit or prohibit this method of slaughter based on the ground reality and after the joint commission carries out its checks.

In addition, the Iftaa` Board recommends that a "Halal" certificate, which is issued by the Jordan Standards and Metrology Organization (JSMO) Conformity Certificate Directorate, is required. It also recommends strengthening the role of oversight regarding this certificate and the stunning process. And Allah The Almighty Knows Best.

Summarized Fatawaa

If a woman becomes pure from menstruation shortly after Fajr in Ramadan, what is required of her?

If a woman becomes pure (from menstrual period) after Fajr, even shortly after, it is recommended (but not obligatory) for her to refrain from eating and drinking for the rest of the day. However, she must make up for that day after Ramadan.
She will be rewarded for both refraining from eating (imsak) and making up the fast (qada) since she was menstruating for part of the day.

When is Istikharah (guidance prayer) Du`a offered, before Tasleem (saying asalamu alikum warahmatu allah wa barakatuh to end the prayer), or after it?

It is offered after Tasleem.

What is the recommended supplication (Du'a) upon breaking the fast, and is it recited before or after breaking it?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.

It is recommended (Mustahabb) for a fasting person to recite upon breaking the fast—that is, immediately after eating or drinking—the supplication: "Allahumma laka sumtu wa 'ala rizqika aftartu" (O Allah, for You I have fasted, and with Your provision I have broken my fast).

This is because our master, the Prophet (peace and blessings be upon him), used to say this. The narration was recorded by Abu Dawud with a good (Hasan) chain of transmission, albeit in a Mursal form (a narration where a Successor reports directly from the Prophet). Shaykh al-Islam Imam Ibn Hajar al-Haytami (may Allah have mercy upon him) stated: "Its Mursal status is inconsequential, as it pertains to virtuous deeds (Fada'il); furthermore, it was connected (Mawsul) through another chain of transmission." [Tuhfat al-Muhtaj, Vol.3/P.425]

It is also recommended to recite: "Dhahaba al-dhama'u wa ibtallat al-'uruqu wa thabata al-ajru in sha' Allah" (The thirst has gone, the veins are moistened, and the reward is confirmed, if Allah wills).

This was recorded by Abu Dawud with a good (Hasan) chain. Our leading jurists (Imams) have explicitly stated that it is recommended for the fasting person to combine both supplications.

Imam al-Bajuri (may Allah have mercy upon him) stated:

"And his saying following his breaking of the fast—that is, it is recommended to say: 'O Allah, for You I have fasted, upon Your provision I have broken my fast, in You I have believed, to You I have submitted, and upon You I have relied. The thirst has gone, the veins are moistened, and the reward is confirmed, if Allah wills. O You of vast bounty, forgive me. Praise be to Allah Who aided me so that I fasted, and provided for me so that I broke my fast. O Allah, grant us success in fasting, enable us to stand in night prayer during it, and aid us in it while people sleep, and admit us to Paradise in peace.'" [Hashiyat al-Bajuri, Vol.1/P.562]

Furthermore, the fasting person may supplicate with whatever good he or she wishes, for the supplication of a fasting person is answered. Al-Bayhaqi recorded on the authority of Anas ibn Malik that the Messenger of Allah (peace and blessings be upon him) said: "Three supplications are not rejected: the supplication of a parent for his child, the supplication of a fasting person, and the supplication of a traveler." And Allah Almighty knows best.

What is the ruling of islamic law on statutory (legal) interest awarded by a court?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.

It is permissible for a person in whose favor a judge has awarded statutory (legal) interest to deduct the actual litigation costs incurred in filing and prosecuting the lawsuit from these interest funds.

Any remaining balance beyond those actual expenses must be returned to the party upon whom the payment was imposed, provided that party is a specific individual. If, however, the paying party is a public entity or state institution, the remaining amount should be spent on the general public interests of Muslims—such as schools, mosques, roads, and similar public utilities shared by the community—or given in charity (Sadaqah) to the poor and needy. And Allah Almighty knows best.
