Resolution No. (30): "Ruling on Dealing with Orphans Funds in Long-Term Transactions"
Date: 7/11/1413 AH, corresponding to 9/02/1993 AD

 

What is the ruling on the criteria adopted by Orphans' Fund Development Foundation?

The Board is of the view that the criteria adopted by the aforementioned foundation is the best for the time being; as well as the Board of Iftaa' urges it to exert more effort as regards continuous development in their methods in order to reach the proper justice while distributing profits and to look for all the means to obtain the best criteria in this regard. And Allah Knows Best.

My brother is settling a debt on my behalf and in return he takes 30% interest as an additional amount of the whole sum. Is this lawful or not?

This additional amount is considered prohibited interest (Riba) according to Islamic law, and it is not permissible to take it. And Allah Knows Best.
 
 
 
 
 

I work for a company whose manager refuses to allow employees to leave during work hours. Do I incur sin if I secretly went out to join the congregation at the Masjid? Is doing so considered a breach of trust?

We recommend that you pray at work to encourage your colleagues to follow suit, because whoever guides to good has the like of the reward of the person who actually does it. And Allah The Almighty Knows Best.

My mother is 70 years old and wishes to perform Hajj and Umrah, as she has never done so before. However, she also takes care of my ill father and is afraid of falling ill herself. What should she do?
 
 
 
 
 
 

If this is the obligatory Hajj – meaning she has not previously performed Hajj or Umrah – then it is permissible for her to go even without her husband's approval. However, she must travel with a Mahram (a male guardian) or a trustworthy group of women, and she should leave someone to care for her husband and attend to his needs. Is it permissible for a woman to ride a taxi without a Mahram (unmarriageable kin) in order to attend a gathering of knowledge?

It is permissible for the woman to pursue the knowledge that she needs in order to perform the religious requirements due on her if there was nobody to teach her at home, provided that there is no temptation involved. Moreover, we don`t recommend that she rides a taxi without a Mahram although such an act isn`t from the forbidden Khulwah (seclusion).
