Resolution No. (294) (14/2020), By The Board of Iftaa', Researches and Islamic Studies:

"Ruling on Preventing Transforming a Mosque into a Kindergarten in Favor of the Ministry of Education"

Date: (14th of Rabi'ul-Akhir, 1442 AH), corresponding to (2/12/2020 AD).

 

All perfect praise be to Allah, the Lord of the Worlds; may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

In its 13nth meeting held on the above date, the Board of Iftaa` reviewed the letter No.4/2/3/4783 sent from His Excellency the Minister of Awqaf, Holy Sites and Islamic Affairs Dr.Mohammad Al-Khalayleh. This letter reads as follows: Is it possible to transform the Old Mosque of Granada (Constructed on endowed land No.(173)-(5), Madaba), along with its annexes, into a kindergarten at the request of the Ministry of Education/ Madaba Qhasaba District? It is worth pointing that there is another mosque in the same area, which is the New Mosque of Granada.

After careful consideration, the Board has arrived at the following decision:

In principle, a religious endowment is bound by the conditions of the endower and should meet the purpose for which it was established in the first place. Consequently, a mosque may not be transformed into something else, such as kindergarten or other. And Allah The Almighty Knows Best.

What is the ruling on eating or drinking during the second Adhan?

It is not permissible to eat or drink during the second Adhan because it announces the break of dawn and the obligation to start fasting. Allah Almighty says {what means}:"and eat and drink until you can discern the white streak of dawn against the blackness of night." [Al-Baqarah/187].
Whoever eats or drinks during this time invalidates their fast, and they must refrain from eating for the rest of the day and make up for the missed fast later.

 

 I`m keeping a plot of land (10 Dunums) for my children. Is it liable for Zakah?

Praise be to Allah, The Lord of the Worlds.

Land that is purchased with the intention of ownership and personal benefit—meaning to retain it for use and not for trade—is not subject to zakāh, as such property is not considered from trade commodities (ʿurūḍ al-tijārah).
 
It is stated in Al-Ḥāwī al-Kabīr:
“If it is property and one intends it for trade, then zakāh is due upon it; but if he intends it for personal possession, then no zakāh is due upon it.” And Allah, the Exalted, knows best.

 

Is Zakah (obligatory charity) obligatory on indebted merchant?

Debt doesn`t abrogate the dueness of Zakah, thus a debtor who has money, articles of merchandise, or other Zakah funds at his disposal should pay their Zakah.

What are the pillars of fasting?

The pillars of fasting are intention and abstaining from all nullifiers of fasting from dawn to sunset.
