Resolution No. (288): "Allocating a Portion of Waqf Programs` Funds for the Waqf Administrator"

Resolution No. (288) (8/2020) by the Board of Iftaa`, Research and Islamic Studies:

"Allocating a Portion of Waqf Programs` Funds for the Waqf Administrator"

Date: (24/Ramadan/1441 A.H), corresponding to (17/5/2020 A.D)

 

Praise be to Allah, the Lord of the Worlds; may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

At its session on 24 of Ramadan 1441A.H (17 May 2020 A.D), the Board considered the letter of His Excellency Minister of Awqaf and Islamic Affairs Dr.Mohammad AlKhalayleh. It included the following:  The Ministry plans to grant scholarships at public Jordanian universities to the children of Imams and other workers of the Ministry where (50) scholarships are to be granted per year in various departments. This is of course in accordance with specific regulations issued to this end and in which it is stipulated that the tuition costs will be provided for from the funds of Waqf programs (Educational Waqf Programs) at public universities in cooperation with the Royal Hashemite Court. It is worth pointing that these staff members are in dire need for these scholarships and receive nothing from the funds of the Waqf programs. Could Your Grace clarify the ruling of Sharia on this matter?

After careful consideration, the Board decided the following:

There is nothing wrong with allocating a portion of the Waqf programs' funds for the General Administrator of the Waqf; the Ministry of Awqaf and Islamic Affairs within the framework of a special system issued by the Ministry to this end and in line with achieving the intended aim. This is based on the view of the majority of scholars who deemed allocating a portion of the Waqf revenues for the Waqf Administrator permissible. And Allah The Almighty Knows Best.

Is a menstruating woman obliged to pray during menses, and should she make up missed prayers?

All perfect praise be to Allah, The Lord of The Worlds                                                                                                                                                                        A menstruating woman is prohibited from prayer during her menses, and she isn`t obliged to make up missed prayers. And Allah Knows Best.

An Arab young man had an illegitimate sexual relationship with a Christian American while she was staying in one of the Arab countries. After she returned to America, she told him that she had doubts that she was impregnated by him. It is worth pointing that it is hard for him to get a visa to the USA. What is the ruling of Sharia on this?

Zina (Adultery and extramarital relations) is one of the grave sins that incur the wrath of Allah if the adulterer didn`t make immediate repentance. However, the child isn`t attributed to the adulterer. Rather, he/she is attributed to the woman who got pregnant by him and, according to Sharia, it isn`t considered a legitimate child of the adulterer. And Allah The Almighty Knows Best.

After I was ran over, I had cracked ribs, concussion, a tension pneumothorax, and retired as a result. What is the amount of the Diya?

All praise is due to Allah the Lord of the worlds. May the blessings of Allah be upon our Master and Prophet Muḥammad and his pure progeny.
 
What you have mentioned requires a detailed medical report since the benefit of every organ that you have lost deserves a full Diya (In Islamic law, Diya is the financial compensation paid to the victim or heirs of a victim in the cases of accidental murder, bodily harm or property damage). Moreover, the decrease in the benefit of some organs has to be assessed by expert doctors and allocated a percentage from the Diya accordingly. Therefore, we advise you to refer the matter to the courts or reconcile with the driver and forgive him so that Allah may forgive you. And Allah The Almighty Knows Best.

Is it allowed to shave my beard to join the army taking into consideration that I can`t find a job?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.

The army should be joined in preparation for Jihad (Fighting in the cause of Allah), so if Jihad contradicts with growing a beard then it is allowed to shave it. And Allah The Almighty Knows Best.
