Resolution No.(278): "Ruling on Renting a Mosque`s Mortuary"

Date Added : 22-05-2019

Resolution No.(278)(12/2019), By The Board of Iftaa',Researches and Islamic Studies:

"Ruling on Renting a Mosque`s Mortuary"

Date: (11/ Ramadan/1440 AH), corresponding to (16/5/2019 AD).

All perfect praise be to Allah the Lord of the Worlds.

During its sixth session held on the above date, the Board reviewed the letter No.(5/5/3/993) sent from His excellency Deputy Director of Awqaf Funds Development Department Dr. Abed Mahmoud Al-Smiraat, and reads as follows:

We would like to bring to Your Grace`s attention the fact that At-Tawbah Funeral Center has applied for renting Al-Ethar Mosque`s Mortuary in Hashmiah area, Zarka. Could you kindly clarify the ruling of Sharia on this?

After deliberating, the Board decided the following:

Endowment properties allocated for mosques should serve the purpose for which they were endowed in the first place without any financial investment returns from private companies. Therefore, the Board is of the view that it isn`t permissible to rent the above mortuary. Rather, it should remain as an endowment for the people to benefit from.  And Allah the Almighty Knows Best.

Summarized Fatawaa

What is required of a traveler or a sick person if they broke their fast and then their excuse ceased?

If a traveler settles or a sick person recovers after having broken their fast, it is recommended for them to refrain from eating and drinking for the rest of the day, but it is not obligatory.

What do you say about someone who stays up all night on Laylat al-Qadr but misses Fajr prayer?

Such a person has deprived themselves of a great reward. Performing obligatory acts is more beloved to Allah than voluntary acts. Fajr prayer is an obligation, and performing it in congregation is equivalent to worshiping for the entire night. So how can someone neglect it while striving for voluntary prayers?!

When does the time for the Fajr prayer begin?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

The time for the Fajr prayer begins once the Mu’adhin starts the second Adhan (Al-Adhan al-Thani), and not after the first Adhan. And Allah the Exalted knows best.

What is the ruling of Islamic Law on a latecomer who joins the imam during the standing position of the first rakʿah but was unable to complete the recitation of al-Fātiḥah?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
If a latecomer (masbuq) joins the prayer while the imam is standing, he should begin reciting Sūrat al-Fātiḥah immediately, without pausing to recite the opening supplication (duʿāʾ al-istiftāḥ) or the seeking of refuge (taʿawwudh). If the imam bows before he completes al-Fātiḥah, he follows the imam into the bow and leaves whatever remains of al-Fātiḥah — the imam bears it on his behalf.
It is stated in ʿUmdat al-Sālik (p. 47): "If a latecomer finds the imam standing and is confident that he has enough time to recite the taʿawwudh and al-Fātiḥah in full, he may do so. If he is uncertain, he should neither recite the opening supplication nor the taʿawwudh, but rather begin directly with al-Fātiḥah. If the imam bows before he completes it, he follows him into the bow — provided he had not already begun the opening supplication or the taʿawwudh. If he had begun either of them, he continues reciting al-Fātiḥah for as long as he spent on them." And Allah the Almighty knows best.
