Resolution No. (263): "Ruling on Installing Solar Energy at the Charity Medical Center from the Treatment's Earnings"

Resolution No. (263) by the Board of Iftaa', Research and Islamic Studies:

"Ruling on Installing Solar Energy at the Charity Medical Center from theTreatment's Earnings"

Date: ( 18/Thu Al-Hija/1439 AD) ,corresponding to (30/8/2018 AH)

On its eleventh session held on the above date, the Board reviewed the letter sent from his Excellency, the General Manager of the Zakah Fund, and it read as follow: 

As Your Grace knows, Wihdat Zakah Committee answers to the Zakah's Fund. Since this committee runs its own medical center, it desires to replace the electrical energy with solar energy against an overall cost of around (15682 JD). Moreover, this sum was taken from the medical center`s earnings (Not from the Zakah fund) and allocated for the aforementioned purpose. In addition, the medical center offers its services to all citizens at minimum costs and serves the poor through field workshops supervised by the Zakah committee. Could you inform us of the Sharia ruling as regards financing the aforementioned project from the medical center`s earnings.
After prolonged deliberations, the Board decided the following:
In principle, there is no harm in using the earnings of the medical center to finance the above project; especially since they are generated by the center, itself and this will save many future expenses and will, hopefully,be reflected on the quality of the offered services. However, this project has to be executed according to the regulations and instructions of the committees supervised by the Zakah Fund. And Allah Knows Best.

What is the ruling on attending relatives` parties held in public halls, or hotels since if we don`t, we will be subjected to their admonition?

If such parties involve mixing between men and women, or forbidden acts such as listening to songs with sinful lyrics, then attending them is forbidden from the view point of Sharia since people`s admonition is nothing compared to Allah`s, The Almighty`s, wrath.

Is an elderly or chronically ill person required to pay additional fidyah if they delay it beyond the first year?

An elderly person or someone permanently unable to fast must pay fidyah by feeding one needy person for each missed day.
However, if they delay paying fidyah beyond the first year, no additional fidyah is required.
This differs from someone who delays making up missed Ramadan fasts (qada) without a valid excuse until the next Ramadan begins—such a person is required to pay an additional fidyah for the delay.

What is the ruling of Islamic Law if the follower (maʾmūm) stands up for the third rakʿah out of forgetfulness while the imam has sat for the middle tashahhud?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
If the imam sits for the tashahhud while the follower (maʾmūm), out of forgetfulness, stands up for the third rakʿah, he is obliged to return to his sitting position, since following the imam is obligatory. In this case, no prostration of forgetfulness (sujūd al-sahw) is required of him. If, however, he fails to return, his prayer is rendered invalid.
Shaykh al-Islām Imām Zakariyyā al-Anṣārī, may Allah have mercy upon him, states: "If the follower stands up alone out of forgetfulness, he is obliged to return, since following the imam is obligatory... If he does not return, his prayer is rendered invalid, due to his departure from what is obligatory." [Asnā al-Maṭālib,Vol.1/P.190] And Allah the Almighty knows best.

What is the Islamic ruling on breaking the bones of the 'aqīqah?

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
It is Sunnah not to break the bones of the 'aqīqah. Rather, each bone should be separated at its joint — as a good omen and expression of hope for the soundness and wholeness of the newborn's limbs. However, if one does break the bones, it is not considered disliked (makrūh) — it is simply regarded as contrary to what is preferable (khilāf al-awlā). And Allah Almighty knows best.
