Resolution No.(238) (6/2017)

"Sighting the Crescent of Ramadan, 1438 AH"

Date: (29/ Sha`ban/1438 AH), (26/5/2017).

All perfect praise be to Allah, The Lord of The Worlds, and may his peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

On its sixths session held on the above date, the Board of Iftaa`, Research and Islamic studies reviewed sighting the crescent of Ramadan for this year/1438 on basis of the astronomical calculations conducted by the crescents committee of the General Iftaa` Department.

After deliberations, the Board decided the following:

In The Name of Allah, Most Gracious,  Most Merciful

Allah, The Almighty, Said (What means): "Ramadhan is the (month) in which was sent down the Qur’an, as a guide to mankind, also clear (Signs) for guidance and judgment (Between right and wrong). So every one of you who is present (at his home) during that month should spend it in fasting"{Al-Baqarah/185}. Allah also Said (What means): "They ask thee concerning the New Moons. Say: They are but signs to mark fixed periods of time in (the affairs of) men, and for Pilgrimage." {Al-Baqarah/189}. Moreover, the Prophet (PBUH) said: "Observe fast on sighting it (the new moon) and break it on sighting it." {Related by Bukhari}.

In compliance with Sharia texts, the Iftaa` Board convened on Friday evening (29th of Sha`baan, 1438 AH, corresponding to 26,5,2017) to sight the crescent of Ramadan, accompanied by the Chief Justice, the Minister of Awqaf, a number of eminent scholars, and experts of astronomy.

Based on the results arrived at by the crescent sighting committee of the General Iftaa` Department and the concerned authorities, and which were harmonious with the astronomical calculations, it was ascertained by the Iftaa` Board that tomorrow, Saturday, is the first day of the holy month of Ramadan for the year 1438 AH, corresponding to 26,5,2017AD.

Accordingly, the Board of Iftaa`, Research and Islamic Studies is privileged to extend the warmest congratulations to His Majesty King Abdullah the second Ibn Al-Hussein, His crown Prince, and the Hashemite Family on this blessed occasion. May Allah protect His Majesty and grant Him good health.

The Board also extends its congratulations to the people of Jordan as well as the Arab and Muslim Nations. It prays that Allah makes it a month of peace, security, faith, goodness and piety. And may Allah accept our fasting and night prayers. And Allah Knows Best.

Summarized Fatawaa

What is the ruling of Islamic Law on wearing energy stones?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
There is no objection to a woman adorning herself with precious and semi-precious stones — such as ruby, carnelian, or the like — so long as these are stones that women customarily wear as adornment.
As for what are known as "energy stones," if they are used with the intention of seeking remedy and healing, then such matters are governed by experimentation and scientific study — which either establishes that they have a tangible effect or does not — and all of this operates by the permission and will of Allah, Glorified and Exalted. If studies or practical experience do establish that such stones carry a beneficial effect upon human health, then there is no objection to using them. They are, after all, part of Allah's creation, much like medicinal substances extracted from plants or derived from other created things — provided that the Muslim does not believe that the stone itself is the source of benefit or harm. It is nothing more than a means among the many means that Allah has placed in this world, and the reality of all affairs belongs to Allah alone. And Allah the Almighty knows best.

What is the ruling if hemorrhoid blood exits after completing ablution?

If this blood is exiting from outside the anus (due to the hemorrhoid protruding), it does not invalidate ablution, because blood exiting from the body from other than the two orifices does not invalidate ablution. If it exits from the anus (meaning from inside it), it invalidates ablution, and one must perform istinja' from it, wash the area of impurity, and repeat the ablution.
However, if this blood exits continuously such that no time remains sufficient for purification and prayer without it flowing, then it takes the ruling of urinary incontinence (sals al-bawl). One then cleanses from it after the time for each prayer enters, performs ablution immediately thereafter, and performs the obligatory prayer immediately. There is no liability upon him after that if something of it flows, and he may pray as many voluntary prayers as he wishes. If he wants to pray another obligatory prayer, he must cleanse himself and perform ablution. And Allah the Almighty knows best.

What should a person do if they suffer from an incurable illness that prevents them from fasting?

A person who has an illness that is not expected to be cured and prevents them from fasting must feed a needy person one mudd (600 grams) of food (such as wheat or rice) for each missed day instead of fasting.
Allah Almighty says {what means}: "and [in such cases] it is incumbent upon those who can afford it to make sacrifice by feeding a needy person." [Al-Baqarah/184].

What are the key differences between the 'aqīqah and the uḍḥiyyah?

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
The following are the key differences between the 'aqīqah and the uḍḥiyyah:
First: The 'aqīqah is slaughtered as an act of drawing closer to Allah the Almighty and expressing gratitude for the blessing of a newborn child. The uḍḥiyyah, on the other hand, is slaughtered as an act of drawing closer to Allah and expressing gratitude to Him specifically during the days of slaughter (ayyām al-naḥr).
Second: The 'aqīqah is performed on the seventh day from the birth of the newborn, whereas the uḍḥiyyah is performed on Eid al-Aḍḥā and its time extends for three days after the Eid.
Third: The 'aqīqah is performed once in a lifetime for the newborn, whereas the uḍḥiyyah is recommended every year for the one who is financially capable to offer it.
Fourth: It is Sunnah for the one intending to offer the uḍḥiyyah to refrain from cutting his hair and nails until after he has slaughtered. This is not a Sunnah for the one intending to perform the 'aqīqah.
Fifth: It is Sunnah for the 'aqīqah to be cooked and distributed to the poor in its cooked form. The uḍḥiyyah, by contrast, must be distributed as raw meat. And Allah Almighty knows best.
