Resolution No.(147): "Ruling on the Commission which a Doctor Takes from Medical Centers"

Resolution No.(147)(12/2010) by the Board of Iftaa`, Research and Islamic Studies: "Ruling on the Commission which a Doctor Takes from Medical Centers"
Date: 17/8/1431 AH, corresponding to 29/7/2010 AD.

 

All perfect praise be to Allah, The Lord of The Worlds; and may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.
During its seventh session held on the above given date, the Board reviewed the following question:
Is it permissible for a doctor to take a commission from a pharmacy, a lab or an x-ray center in return for directing patients to them? However, if they declined from paying him, he would direct the patients somewhere else.
After careful study and deliberation, the Board decided what follows:
Such an act is impermissible and belittles the medical profession-which has been originally established to serve humanity- for the following:
First: It deceives the patient into believing that a certain lab or x-ray center is the best and this is forbidden. Allah Says in this regard (which means): "O ye who believe! Fear God and be with those who are true (in word and deed). {At-Tawbah/119}.
Second: It involves eating up people`s money unjustly because the doctor takes money for nothing and burdens the patient with extra expenses in addition to the already expensive treatment and medications. Allah, The Almighty, has forbidden eating up people`s money unjustly. He says{which means}, "O ye who believe! Eat not up your property among yourselves in vanities: But let there be amongst you Traffic and trade by mutual good-will: Nor kill (or destroy) yourselves: for verily God hath been to you Most Merciful!"{At-Tawbah/119}.
Third: It corrupts the doctor`s credibility and turns him into a materialistic person, who aggravates the suffering of patients instead of comforting them and relieving their pain.
Fourth: It violates the ethics of the medical profession. However, if the patient sought the advice of the doctor as regards a suitable lab or x-ray center, then the latter should be sincere to him because an advice is a trust. This is indicated by the Hadith in which the Prophet (PBUH) said: "The deen (religion) is naseehah (advice, sincerity).” We said: “To whom?” He (PBUH) said: “To Allah, His Book, His Messenger, and to the leaders of the Muslims and their common folk.” [Muslim]
Therefore, it is imperative that doctors avoid such suspicious matters and give advice to their patients seeking the reward from Allah, The Almighty. And Allah Knows Best.

What is the ruling on a young man and a young woman having a love relation for the purpose of getting married?

It is forbidden for a man and a woman to have any kind of relation whether for marriage, or not because it leads to committing sin. Such relations include: private meetings, mixing, gazing, and seclusion (Khulwa). Accordingly, one who is sincere in his intentions should go to the woman`s guardian and ask for her hand in marriage.

What should someone do if they fasted for only 28 days in their country and then traveled to a place where Eid has already been declared?

If a person fasts in their country and then travels to another country where Eid has been declared, they must celebrate Eid with the people of that country.
● If their total fasts add up to 29 days, nothing is required of them.
● However, if they have only fasted 28 days, they must make up one day after Eid, because an Islamic month cannot be only 28 days.

What is the ruling on congregational prayer performed outside the mosque, and is it a condition that it be performed in a mosque in order to attain the full reward?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.
It is not a condition for attaining the reward of congregational prayer that it be performed in a mosque; however, a Muslim should still be keen to perform his prayers in the mosque, so as not to miss out on immense reward. This is due to the virtue of the mosque and of spending time there (i‘tikāf), the typically larger number of worshippers present, and the additional reward gained through walking to and from the mosque. On the authority of Abū Hurayrah (raḍiyallāhu ‘anh), the Messenger of Allah ﷺ said: "Whoever purifies himself in his house, then walks to one of the houses of Allah to fulfill one of the obligations Allah has prescribed, one of his steps will erase a sin, and the other will raise him a degree [in status]." (Related by Muslim)
Whoever misses congregational prayer at the mosque should still strive to pray in congregation at his workplace, or together with the members of his household. And Allah, the Exalted, knows best.

What is the ruling of Islamic Law on kissing while fasting?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is prohibitively disliked (makrūh taḥrīman) for a husband to engage in foreplay with or kiss his wife during the daylight hours of Ramaḍān if doing so stirs his desire. If pre-seminal fluid (madhī) is released as a result, the fast is not invalidated; however, if seminal fluid (manī) is released, the fast is broken.
Imām al-Khaṭīb al-Sharbīnī, may Allah have mercy upon him, stated: "It is prohibitively disliked to kiss — whether on the mouth or elsewhere — for one whose desire is stirred, whether man or woman, to the extent that he fears it may lead to intercourse or ejaculation. Embracing, touching, and similar acts without a barrier carry the same ruling as kissing in this regard, because such acts expose the act of worship to being corrupted — and as the two Ṣaḥīḥs record: 'Whoever circles around a protected boundary is liable to fall into it.'"
He further added: "It is preferable for one whose desire is not stirred — even if he is a young man — to refrain from such acts as well, so as to close the door entirely. For he may believe his desire has not been aroused when in fact it has.
