Resolution No.(104): “Ruling on the Medical Insurance of those Working for the American Jordanian Company for Apparel (Jordache)“

Resolution No.(104) by the Board of Iftaa`, Research and Islamic Studies:

“Ruling on the Medical Insurance of those Working for the American Jordanian Company for Apparel (Jordache)“

Date: 5/4/1427 AH, corresponding to 3/5/2006 AD.

 

 

 

 

Question:

What is the Sharia ruling as regards the medical insurance of the workers of the American Jordanian Company for Apparel (Jordache) at the general clinics?

Answer: All success is due to Allah.

The Board is of the view that medical insurance is a branch of cooperative insurance, which is considered from the bare contracts. This contract isn`t affected by the contributors` ignorance as regards its benefit to them because they are contributors. Moreover, it isn`t risky, usurious or aleatory. 

Taking the above medical insurance into consideration, we realize that it takes the same ruling as cooperative insurance, which is an insurance with an institution that cares about workers, and isn`t a traditional insurance company. However, the Board recommends adjusting the maximum of age: (until  fifty) to become (as long as he works for the company).

The Board also recommends deleting article (14) of the draft agreement so as for the medical insurance to become effective through that institution`s commitment to cover the workers medical care during the period assigned in the draft. Based on that, the medical insurance included in the future draft agreement becomes permissible from the view point of Sharia. And Allah Knows Best.

I suffer from chronic asthma which requires ventoline inhale; which is an air causes the risperatory track/airways to expand. Am I permited to use it during the daylight of Ramadan? And does break one's fast? Noting that I can't go an entire day without using it?

Taking inhaler through the mouth or the nose breaks one's fast, because it is meant to reach the lungs which are part of the coelom. Therefore, whosoever use inhalers for couple of days is obliged to preserve his fasting and make up that day later. As for the ones the ones who need to use it every days are obliged to preserve his fast and feed a poor per day and the cost of feeding one poor is estimated (60) piasters for the year (1421AH). And Allah Knows Best.  

I underwent a procedure for a molar pregnancy (hydatidiform mole), and after that, the bleeding continued for more than two months, during which I did not pray. Do I need to make up the missed prayers?

If you have previously experienced postpartum bleeding, the duration of the current bleeding is treated the same as your previous postpartum period. Any bleeding that exceeds this duration must be considered irregular bleeding (istihada), and you must make up the missed prayers. If this is the first time, then any bleeding beyond sixty days is considered irregular bleeding. You must perform ghusl, pray, and make up the prayers for the days beyond the sixty-day limit. And Allah Knows Best.

What is the ruling on making a false oath?

Making false oath indulges its maker in Hell; therefore, he is obliged to repent, ask Allah for forgiveness and make an expiation; feeding 10 poor or providing clothes for them and in case of incapability of doing any of latters he should fast for 3 consecutive days. And Allah Knows Best. 

Are phone conversations between the two sexes permissible if for consultation, and within the limits of good manners?

Such act is impermissible since it renders hearts corrupt, and could lead to forbidden attachment. Allah, The Almighty, Says (What means): "and follow not the footsteps of the devil." [Al-Baqarah/68].
