"Transferring the Status of Masjid from one Floor to another"

Date: (24/ Sha`ban/1443 AH), corresponding to (27/3/2022 AD).

 

All perfect praise be to Allah, The Lord of The Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all His family and companions.

At its 3rd meeting held on the above date, the Board reviewed the letter No.(2363/1/1/9) of His Excellency Minister of Awqaf And Islamic Affairs Dr. Mohammad Al-Khalayleh. In this letter, the Director of the1st Awqaf Directorate and Amman requested dividing the ground floor of Masjid Hasan Abu Sha`iera (Marka) into a residence for the Imam and Mo`azin since they were officially appointed to this Masjid. It is worth pointing that the ground floor was a Masjid before the Masjid`s Committee built a first floor that was used into a Masjid. Currently, the ground floor is furnished with carpets and was used as a prayer place for women. Is it permissible to turn the ground floor, which was used as Masjid, into a residence for the Imam and the Mo`azin?

After deliberating, the Board arrived at the following decision:

It is permissible for the Administrator of the Public Waqf-The Ministry of Awqaf and Islamic Affair-to transfer the status of Masjid to the first floor and establish prayers there. It is also permissible to turn the ground floor into a residence for the Imam and the Mo`azin. However, this is provided that a special section is allocated as prayer place for the women, and this way the best interest of this Waqf is achieved and from different perspectives. Al-Mawardi, a Hanbali scholar, stated in {Al-Ensaaf}: "It is permissible to add a new floor as a Masjid if most of the praying people wanted that and to turn the lower floor into a place for providing drinking water and shops. This was stated by Imam Ahmad and adopted by Al-Khadhi." And Allah The Almighty Knows Best.

What is the ruling on a woman using contraception without her husband's knowledge if he is mistreating her?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is not permissible for a woman to use any means of delaying pregnancy without her husband's knowledge, consent, and mutual agreement. This is because having children is a sharʿī right belonging to both spouses equally in Islamic law. Imām al-Māwardī, may Allah have mercy upon him, stated: "The right to a child from a free woman is shared between them both" — meaning between the two spouses. [al-Ḥāwī al-Kabīr, 9/320]
It is therefore not permissible for either spouse to make a unilateral decision regarding the prevention of pregnancy without the consent of the other. We advise both spouses to discuss the matter with wisdom and mutual respect, so as to resolve any disagreement and arrive at a suitable solution that serves the interests of them both. And Allah the Almighty knows best.

What is the ruling on wiping the white area behind the ears instead of wiping the head?

The obligation in ablution is to wipe some of the head; it is not a condition to wipe all of it. Wiping the white area behind the ears suffices for that. And Allah the almighty knows best.

Does the use of suppositories, enemas, or hemorrhoid creams affect the validity of fasting?

Enemas and suppositories inserted through either of the two private passages invalidate the fast. This ruling is based on the statement of Ibn Abbas (may Allah be pleased with him): "Breaking the fast occurs from what enters (the body), not from what exits." [Reported by Al-Bayhaqi in As-Sunan Al-Kubra]
His generalization regarding anything entering the body indicates that it invalidates fasting, whether it is nutritious or not, as even non-nutritious substances resemble food in form.
It is recommended to use them before Fajr or after Iftar. However, if a person must use them while fasting, they should continue refraining from food and drink for the rest of the day and make up for that day later.

Is it permissible for household members to pool money for the Udhiyah and gift it to one of them?

Praise be to Allah, and peace and blessings be upon our master, the Messenger of Allah.
 
It is permissible for members of a household to pool their money together and gift the total amount to one individual among them so that he may offer the sacrifice (Udhiyah). In this case, the family members receive the reward for giving charity (Sadaqah), and the one performing the sacrifice includes them in the spiritual reward (Thawab).
 
Furthermore, slaughtering a single sheep (on one's own) is considered religously better than participating as one of seven people in the sacrifice of a cow or a camel. And Allah the Almighty knows best.
