About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. Should Al-Basmalah (i.e. saying Bismillaaahi Ar-Rahmaani Ar-Raheemi) be recited after Takbeerat Al-Ihram (saying Allahuakbar) which marks the beginning of prayer?

All perfect praise be to Allah,The Lord of The Worlds A praying person is obliged to recite Al-Basmalah at the beginning of Chapter Al-Faatihah, and in every Rak`ah (unit of prayer) because it is a verse of it. And Allah Knows Best.

Is it permissible for a person to sever ties with his sister because her husband had quit prayer and done him harm?

A sister is a blood-relative and maintaining blood-relations is obligatory in Islam. As regards her husband, he should be invited to the way of Allah with wisdom and beautiful preaching.

I swear that I will leave the religion of Allah if I return to smoking" and then returned to smoking. What is the ruling?

Whoever conditions disbelief on something and intends to disbelieve if it happens, he becomes a disbeliever immediately. Therefore, you must pronounce the two testimonies of faith (Shahada) and reconcile with your wife if she is in her waiting period (Iddah). It is recommended to consult the Department of Fatwa for further guidance. And Allah Knows Best.

Is permissible to buy/sell with non-Muslim?

Yes buying/selling for a Muslim with non-Muslim is permissible as regards what is lawful.

Is it permissible to use the term 'Al-Jalalah' (Majesty) for anyone other than Allah, The Exalted?

In the Arabic language, a man of dignity and reverence is described as 'Jaleel' (noble), and similarly, an elder or a woman of dignity may be described as 'Jaleelah'. In such contexts, one may use the title 'His Majesty' or 'Her Majesty.' However, the Majesty of Allah, The Exalted, is unlike the majesty of humans, just as His hearing is not like our hearing, and His sight is not like our sight. And Allah The Almighty Knows Best.

Is it permissible to offer one Rak`ah in Witr prayer?

The minimum of Witr (An odd number prayer performed between Isha`a and Fajr) prayer is one Rak`ah, and the maximum is eleven, but the minimum of its complete form is three, and it is permissible to offer one only.

Is a wife considered divorced if her husband refused to go to bed with her (for sexual intercourse) for two months?

A wife doesn`t get divorced no matter for how long her husband refuses to have sex with her, and she had better go to court.
