Ruling on Celebrating the Prophet`s Birthday

 

On the twelfth of Rabi` al-Awal of each Hijri year, the Muslim World celebrates the birthday of Prophet Mohammad(PBUH). The General Iftaa` Department is pleased to congratulate the Muslim and Arab Nations on this happy occasion, and prays that at the same date of next year Allah would have favored them with peace, stability and honor.
We call on all Muslims in the Hashemite Kingdom of Jordan to participate in this celebration to show their love and high regard to our Prophet Mohammad(PBUH), remembering his words: "None of you is a believer till I am dearer to him than his child, his father and the whole of mankind."{Agreed upon}.
On this happy occasion, Muslims gather to recite the Quran, read the biography of the Prophet(PBUH) and chant Madih to honor him as well as to rejoice at his birth(Mawlid). These acts are amongst the good practices referred to by the Prophet(PBUH) where he said," Whoever introduces a good practice that is followed after him, will have a reward for that and the equivalent of their reward, without that detracting from their reward in the slightest"{Muslim}.
The permissibility of celebrating this happy occasion is indicated by many pieces of evidence, some of these are:
First: Abu Qatadah Al-Ansari (RAA) narrated, ‘The Messenger of Allah (PBUH) was asked about fasting on the day of Arafah (the 9th of the month of Dhul Hijjah). He replied, "Fasting on the day of Arafah is an expiation for the preceding year and the following year.” He was also asked about fasting on the day of Ashura (the 10th of the month of Muharram). He replied, “Fasting on the day of Ashura is an expiation for the preceding year.” The Messenger of Allah (PBUH) was also asked about fasting on Monday, and he replied, "This is the day on which I was born and the day on which I was sent (with the Message of Islam) and the day on which I received revelation." Related by Muslim. In this Hadith, the Prophet clarifies that he Fasted on Monday because it is his birthday which distinguishes that day from the rest of the days, and a Muslim should be keen on receiving as many rewards from Allah as possible during this blessed day.
Second: Allah, The Almighty, said, " and teach them to remember the Days of God."{Ibrahim/5}. i.e. teach them to remember the favors that Allah has bestowed upon them, as interpreted by Ibn Abbas, Mujahid and Qotadah, and the Prophet`s birthday is undoubtedly the greatest favor that Allah has bestowed upon the whole World; therefore, celebrating it means complying with the commands of Allah by remembering His favors and blessings.
Third: Allah, The Almighty, said, "Say: "In the bounty of God. And in His Mercy,- in that let them rejoice": that is better than the (wealth) they hoard"{Younis/58}. Ibn Abbas said, "The bounty of Allah is knowledge and His mercy is Prophet Mohammad(PBUH)." Moreover, Allah, The Almighty, said, "
We sent thee not, but as a Mercy for all creatures."{Al-Anbiya`/107}. Therefore, celebrating the birthday of the master of all creatures(PBUH) is one aspect of the prescribed rejoice.
Fourth: When the Prophet (PBUH) came to Medina, he found (the Jews) fasting on the day of 'Ashura' (i.e. 10th of Muharram). They used to say: "This is a great day on which Allah saved Moses and drowned the folk of Pharaoh. Moses observed the fast on this day, as a sign of gratitude to Allah." The Prophet (PBUH) said, "I am closer to Moses than they." So, he observed the fast (on that day) and ordered the Muslims to fast on it."{Bukhari}. Therefore, thanking Allah, annually, for bestowing a favor or removing an affliction is permissible, and amongst the greatest blessings and favors on that day is the birth of Prophet Mohammad(PBUH).
We should remind ourselves and our Muslim brothers to follow our role model Prophet Mohammad(PBUH) in terms of his manners, words and deeds. Allah, The Almighty, said, "Verily there is for you a good example in the Messenger of God for whoever hopes for [the encounter with] God and the Last Day, and remembers God often."{Al-Ahzaab/21}.
We beseech Allah, The Almighty, to protect our country, favor it with peace and security along with the rest of the Muslim countries.

What is the ruling on swearing an oath by the Prophet ﷺ, and does such an oath take effect according to Imām Aḥmad ibn Ḥanbal, requiring expiation upon its breach?

Swearing an oath by a created being is disliked (makrūh) in our Shāfiʿī school. Shaykh al-Islām Imām al-Nawawī, may Allah have mercy upon him, states: "Swearing by a created being is disliked — such as swearing by the Prophet, the Kaʿbah, Jibrīl, the Companions, or the Prophet's family. Al-Shāfiʿī, may Allah have mercy upon him, said: 'I fear that swearing by other than Allah the Almighty may constitute an act of disobedience.' The scholars of the school explained this to mean: that is, something forbidden and sinful — indicating that he had some hesitation in the matter. Al-Imām stated: the established position of the school is that it is categorically not forbidden, but rather disliked. Furthermore, whoever swears by a created being, his oath does not take effect and no expiation (kaffārah) is required if he breaks it." [Rawḍat al-Ṭālibīn wa ʿUmdat al-Muftīn, Vol. 11/P.6]
According to the Ḥanbalī school, however, expiation becomes obligatory upon one who swears by our master the Prophet ﷺ and then breaks his oath. Imām al-Bahūtī al-Ḥanbalī, may Allah have mercy upon him, states: "No expiation is required for swearing by other than Allah the Almighty, even if the oath is broken — because expiation was made obligatory for swearing by Allah and His attributes, out of reverence for His names, and nothing else is equal to Him in this regard... except in the case of swearing by our Prophet Muḥammad ﷺ, for expiation becomes obligatory when one swears by him and then breaks the oath. This was explicitly stated in the narration of Abū Ṭālib, because he is one of the two conditions of the two testimonies of faith by which a disbeliever becomes a Muslim. Ibn ʿAqīl held the view that swearing by any of the other prophets, peace and blessings be upon them all, carries the same ruling." [Sharḥ Muntahā al-Irādāt, Vol. 3/P.441]. And Allah the Almighty knows best.

Is it incumbent on the fiancée to obey her fiancé?

When the woman settles in her husband`s house, it is incumbent on him to provide for her and it is incumbent on her to obey him. Before that, and if the marriage contract had been concluded, then she is lawfully his wife and thus she should abide by custom in treating him, but if the marriage contract hadn`t been concluded, then she should treat him as a non-Mahram (Marriageable).

How is the niṣāb (minimum threshold) of gold calculated when one owns gold of multiple different karats?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.
Zakāh is obligatory on cash and on gold designated for saving or for trade, provided the total reaches the niṣāb (minimum threshold liable for Zakah), and a full ḥawl (lunar year) has elapsed over it. The niṣāb is (85) grams of 24-karat gold; for 21-karat gold, the niṣāb equals (97) grams; and for 18-karat gold, it equals (113) grams.
If one owns gold of multiple different karats, the person paying zakāh should calculate the monetary value of all the gold he owns, combining these values together to determine whether the total reaches the niṣāb. He then pays zakāh on this combined monetary value, once the total reaches the niṣāb. The relied-upon position is to calculate the zakāh based on the buying price [i.e., the price the gold merchant would pay the owner to purchase the gold from him] on the day the zakāh obligation is due. And Allah, the Exalted, knows best.

What is the ruling on omitting the prostration of recitation?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
The prostration of recitation (Sajdat al-Tilawah) is a Sunnah for both the reader and the listener. There is no sin in omitting it, though doing so results in missing a great reward. Muslim narrated from Abu Hurairah (may Allah be pleased with him) that the Prophet ﷺ said: 'When the son of Adam recites a verse of prostration and prostrates, Shaytan withdraws weeping, saying: "Woe to him! (and in the narration of Abu Kuraib: "Woe to me!") The son of Adam was commanded to prostrate and he prostrated, so Paradise is his; and I was commanded to prostrate and I refused, so the Fire is mine."'
 
Sheikh al-Islam Imam al-Nawawi (may Allah have mercy on him) stated: 'It is recommended to prostrate immediately after reciting or hearing a verse of prostration. If one delays it but the interval is short, he may still prostrate. However, if the interval is long, the opportunity is missed.' [Rawdat al-Talibin Vol.1/P.323].
 
Furthermore, the prostration of recitation becomes obligatory (Wajib) in congregational prayer if the Imam prostrates, out of the necessity of following him. And Allah the Exalted knows best.
