What is the ruling of Islamic Law if the follower (maʾmūm) stands up for the third rakʿah out of forgetfulness while the imam has sat for the middle tashahhud?
All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
If the imam sits for the tashahhud while the follower (maʾmūm), out of forgetfulness, stands up for the third rakʿah, he is obliged to return to his sitting position, since following the imam is obligatory. In this case, no prostration of forgetfulness (sujūd al-sahw) is required of him. If, however, he fails to return, his prayer is rendered invalid.
Shaykh al-Islām Imām Zakariyyā al-Anṣārī, may Allah have mercy upon him, states: "If the follower stands up alone out of forgetfulness, he is obliged to return, since following the imam is obligatory... If he does not return, his prayer is rendered invalid, due to his departure from what is obligatory." [Asnā al-Maṭālib,Vol.1/P.190] And Allah the Almighty knows best.
Who is responsible for performing the aqiqah?
All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
The one upon whom the 'aqīqah is incumbent is whoever is obligated to financially maintain the newborn — whether the father, paternal grandfather, or mother. It is to be performed from their own wealth, not from the wealth of the newborn child.
As for one upon whom the financial maintenance of the newborn is not obligatory, they may not perform the 'aqīqah except with the permission of the one upon whom it is obligatory — namely, the father. And Allah Almighty knows best.
What is the ruling of Islamic Law on shaving body hair and clipping the nails for one who is in a state of major ritual impurity (*junub*)?
All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is recommended for one in a state of major ritual impurity (junub) not to remove anything from his body until after the ritual bath (ghusl). It is stated in Bushrā al-Karīm bi-Sharḥ Masāʾil al-Taʿlīm (p. 135): “It is recommended for one in a state of janābah and the like not to remove anything from his body until after ghusl, because the parts of the body return to him in the Hereafter, and he returns in a state of janābah, as a rebuke to him. Then it is removed from him, except for the original parts. It is said that every hair demands its due for its janābah.”
It is stated in Ḥāshiyat al-Shabrāmallisī ʿalā Nihāyat al-Muḥtāj (Vol.2/p.341): “If he wishes to combine shaving and the Friday ghusl, he should delay the shaving until after the ghusl if he is in a state of janābah, so that the ghusl removes its trace from the hair.” And Allah Almighty knows best.
