Subject : Making Investment in Companies that Serve Wines is Impermissible

Fatwa Number : 434

Date : 03-01-2010

Classified : Partnership in Business

Fatwa Type : Search Fatawaa

Question :

We would like to invest in one of the hotels ranked as 5 stars inside Jordan. It is  stipulated that wines must be served in terms of licensing; therefore, would you clarify the juristic aspects in this regard? And does the ruling differ in case a donation was allocated from all the revenues out of wines' sale?

The Answer :

All perfect praise be to Allah, The Lord of The Worlds and may His peace and blessings be upon our Prophet Muhammad and upon all of his family and companions.

The impermissibility as regards being a part of the economic institutions that deal with wines or depend on unlawful revenues/transactions is an obvious matter.

Besides, spending the profit out of the unlawful earnings  won't render institutions' partnership/business as a lawful one since according to the Islamic law, end doesn't justify the means.

Further, giving charity from ill-gotten money isn't considered as a charity; rather, it is called getting rid of the unlawful since the Prophet (PBUH) said (What means): "God is good and accepts only what is good." [Related by Moslim]. In addition, getting rid of ill-gotten money is one of repentance's conditions and being a part of such institutions isn't an act of repentance; rather, it is embark boldly upon continuous unlawful earnings and spending the profit on public interests won't render a person sinless but both sincere repentance and giving up unlawful earnings are conditioned in order to be free from the liability.

Therefore, we advise you (Questioner) to avoid being a partner in the hotels mentioned above and how lovely if hotels that don't involve the unlawful were built in which the one who is adherent to the teachings of Islam will have the choice of not being intermingled with sinful people even if they weren't attributed as "5 stars hotels". And Allah Knows Best.
