The Response of the Iftaa’ Department to What Some Media Outlets Have Published Concerning "Women Driving Cars"

All praise is due to Allah, and may peace and blessings be upon our Master, the Messenger of Allah.

The General Iftaa’ Department had previously issued several fatwas, numbered (862) and (1296), affirming the permissibility of women driving cars and exercising their right to mobility without sin or prohibition. These fatwas were published on the Iftaa’ Department’s website on (25/07/2010) and through various media outlets as well.

The basis of this ruling is that mobility through means of transportation—whether traditional or modern—is a universal human right. The Sharia does not prohibit it, whether for men or women. Rather, it affirms and defends this right, considering the protection of human rights a fundamental objective of the noble Sharia. This is supported by numerous well-established narrations from the Prophetic Sunna, which document the Sahabiyat (The righteous women who met the Prophet Muhammad {Peace be upon him}, believed in him as the Messenger of Allah and died as Muslims) exercising this right without any objection. This is the fatwa that the General Iftaa’ Department has consistently upheld in response to numerous inquiries it receives regularly.

As for what was stated in Fatwa No. (914) regarding the rejection of arbitrary restrictions imposed by some husbands on their wives, it reaffirms the above. It is not a husband’s right to prevent his wife from using modern means of communication, such as the telephone, just as it is not his right to oppress her by depriving her of visiting her family or fulfilling her duties. Conversely, the wife must also consider the reasons for harmonious marital life and safeguard the household from discord and disruption. Thus, she should seek her husband’s permission before leaving for non-essential needs, as the husband is a guardian and is responsible for his household. His responsibility entails observing these rulings so that both spouses are clear about their rights and obligations.

What some media outlets have done—by isolating the phrase "driving cars" out of context, neglecting to mention the human rights affirmed by the fatwa, and falsely attributing to the Iftaa’ Department the prohibition of what Allah and His Messenger have not forbidden—is an act far removed from integrity and objectivity. It violates the covenants of truthfulness and trustworthiness that a Muslim must uphold in their work and duties. This necessitates that discerning audiences verify and ascertain the facts before engaging in discussions that lack any established basis.

In the Name of Allah, and may peace and blessings be upon our Master, the Messenger of Allah.
 
There are several Sunnahs (prophetic traditions) and etiquettes that are highly recommended for the person offering an Udhiyah (sacrificial offering) to observe:
 
First:
It is a Sunnah for anyone intending to offer a sacrifice to refrain from cutting or removing any of their hair or nails once the first ten days of Dhul-Hijjah begin. This is based on the statement of the Prophet (peace and blessings be upon him): "When the ten days [of Dhul-Hijjah] begin and one of you intends to offer a sacrifice, let him not touch any of his hair or skin." (Narrated by Muslim)
 
However, if someone does happen to remove any hair or nails, they have not committed a sin, and their sacrifice remains perfectly valid.
 
Second:
The person offering the sacrifice should ideally slaughter the animal themselves. If they are unable to do so, they should at least witness its slaughter. This is drawn from what our Master, the Messenger of Allah (peace and blessings be upon him), said to Lady Fatima (may Allah be pleased with her):
 
"Stand up and witness your sacrifice, for with its very first drop of blood, every sin you have committed will be forgiven." (Narrated by Al-Tabarani in his Mu'jam, Al-Hakim in his Mustadrak, and Al-Bayhaqi in his Sunan)
 
Third:
Face the Qiblah (the direction of prayer) at the time of slaughtering, as the Qiblah is the most honorable of directions.
 
Fourth:
Pronounce the name of Allah (Tasmiyah) at the moment of slaughter by saying: "Bismillah ar-Rahman ar-Rahim" (In the Name of Allah, the Most Gracious, the Most Merciful). Even if one forgets to say it, the meat remains lawful (Halal) to eat. Allah, Blessed and Exalted is He, says:
 
"So eat of that [meat] upon which the name of Allah has been mentioned." (Al-An'am: 118)
 
It is also recommended to send blessings upon our Master, the Messenger of Allah (peace and blessings be upon him), and to follow it with the Takbeer (Allahu Akbar).
 
Fifth:
Supplicate for acceptance by saying: "Allahumma hadhihi minka wa ilayka, fa-taqabbal minni" (O Allah, this is a blessing from You and is offered back to You, so please accept it from me). This means: This sacrifice is a blessing that originated from You, and I am offering it to draw closer to You. And Allah the Almighty Knows Best.

A man insulted the Divine Essence; is it obligatory for him to perform Ghusl?

Insulting or blaspheming the Divine Essence (Dhat al-Ilahiyyah) constitutes apostasy (Riddah). The perpetrator of this grave sin must immediately repeat the two testimonies of faith (Shahadah) and sincerely repent to Allah the Exalted. It is recommended (Sunnah) for them to perform a ritual bath (Ghusl), though it is not a mandatory condition [for the validity of their return to Islam]. And Allah the Exalted knows best.

Is it permissible to read from the Mus-haf during Tarawih prayer?

Yes, it is permissible to read from the Mus-haf during Tarawih prayer, provided that excessive movements that invalidate the prayer are avoided.
However, it is preferable for the imam to be a memorizer of the Quran and to recite from memory.

Is the marriage, which lacks a valid legal contract, a guardian, and a court registration, valid?

It is incumbent that a valid marriage contract be concluded in the presence of a guardian and two trustful witnesses, and it should be registered in the court to protect the rights of the wife. Actually, a valid marriage contract is what differentiates between sound marriage and fornication.
