On the Occasion of Launching the Iftaa` Department`s Website

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions. This website serves as a means for the General Iftaa Department in the Hashemite Kingdom of Jordan to communicate with the Muslim community, receive their questions and inquiries, and provide answers, God willing. Through this website, they can also access the research and information available at the Department that it wishes to share with them. The Department is an official entity as it is one of the academic institutions in the kingdom. Therefore, it is keen on providing accurate and verified answers. It has entrusted a group of muftis working within the Department to answer questions. They formulate the answers and discuss them among themselves, taking into consideration the evidence from the Quran, the Sunna of the Prophet Mohammad (peace be upon him), and the deductions of the Islamic jurists whose opinions and interpretations are accepted and respected by the Muslim community. A group of competent researchers assists the muftis. The Department has a committee that addresses issues requiring a collective fatwa (Religious edict). However, for emerging matters, issues of general societal concern, and cases forwarded to the Department by official entities such as ministries, these fall under the jurisdiction of the Iftaa` Council, which comprises a select group of scholars. For matters requiring specialized knowledge, the Council may also seek expertise from specialists in fields like medicine, chemistry, and astronomy. The Department exchanges opinions and expertise with fatwa institutions in the Arab countries. It also welcomes suggestions from readers who have experience in managing such websites. Additionally, we encourage receiving questions related to Islamic sciences, and we pray to Allah for guidance in providing accurate answers. Asking scholars about religious matters is a religious duty. Allah, The Almighty Says (What means): "So ask the people of the message if you do not know" [An-Nahl/43]. The Prophet Mohammad (peace be upon him) also said: "Why did they not ask when they did not know? The only cure for ignorance is to ask." [Abu Dawood]. This is because a Muslim is keen to ensure that their actions are in accordance with Islamic law. Allah The Exalted Says (what means): "So whoever follows My guidance will neither go astray [in the world] nor suffer [in the Hereafter]" [Taha/123]. In conclusion, we hope to assist our Muslim brothers in understanding the religious rulings so that they may act upon them. What is the ruling of Islamic Law on someone who wakes up in a state of janābah (major ritual impurity) near the very end of the prayer's designated time, during cold weather — should he heat water in order to perform ghusl, even though the prayer's time will expire as a result, or should he perform tayammum instead?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.
If the water is cold, and cannot be used due to fear of harm that is not ordinarily tolerable, or that would result in illness, then in this case it becomes obligatory to heat the water — even if heating it causes the time for Fajr to expire — and no sin is incurred in doing so, due to his valid excuse. He may not resort to tayammum (dry ablution) instead, since water remains available [and merely needs to be heated].
Imam Shihāb ad-Dīn Aḥmad ar-Ramlī (raḥimahullāh) said: "He was asked regarding a person who, if he were to use cold water, would experience harm that permits tayammum, and who has access to something with which he could heat the water — but if he heats it, the prayer's time will expire. Is it obligatory for him to heat it even if the time expires, or should he pray with tayammum within the prescribed time? He answered that it is obligatory for him to heat the water, even if the time for that particular obligatory prayer expires." [Fatāwā ar-Ramlī, Vol.1/P.98]
Imam al-Bājūrī (raḥimahullāh) said in his Ḥāshiyah on Sharḥ Ibn Qāsim (Vol.1/P.173): "And if he fears [harm] from using cold water, and is currently unable to heat it, but knows of a place where firewood is available, such that if he were to go there he would not return until after the prescribed time has expired — what appears [to be the correct position] is that it is obligatory for him to go and seek the firewood, even if the time expires as a result, as this is the position ultimately settled upon by ar-Ramlī, and as related from him by Ibn Qāsim." And Allah, the Exalted, knows best.

What is the ruling on purchasing sacrificial animals and authorizing their slaughter via telephone?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.
 
It is preferable for the one offering a sacrifice (udhiyah) to slaughter the animal himself, in adherence to the Sunnah, or to be present at the slaughter if possible.
 
It is valid to authorize a butcher to purchase a sacrificial animal on his behalf and slaughter it, regardless of whether the animal is owned by the butcher or the butcher is acting as an agent in its sale—according to the Hanbali school—provided that the butcher specifically designates and purchases the animal for the person offering the sacrifice before slaughtering it. And Allah Almighty knows best.

How should a person who is afflicted with continued major ritual impurity (incontinence of urine, bleeding outside the monthly period) perform ablution?

Such a person should make ablution for every prayer after its due time and after removing impurities from their body and outfit, and should place a fresh diaper whenever needed so as for the impurity not to spread out. They should also perform prayer immediately even if incontinence of urine continued, and should repeat the aforementioned for every obligatory prayer, then perform optional prayer as much as they want.

Is it permissible for a menstruating woman to recite the Quran from the computer without actually touching the Quran?

It is not permissible for a woman in her menstrual period, or in postpartum to recite the Quran, even by heart, or without actually touching the Quran itself. Recitation itself is what is prohibited on her regardless of how it is done. However, it is permissible for her to surf through the Quran by her eyes, or to recall it in her head without uttering the words. There is no harm for her to look at the Quranic verses on the computer without touching it, or to utter the words as this is called looking not reciting or reading.
