About the General Fatwa Department

The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. What is the Islamic ruling when parents oblige their son or daughter to divorce or marry, and this actually takes place, although it is against their will?

When the husband utters the word of divorce, without being forced or threatened, divorce takes place and we recommend that you visit the General Iftaa` Dept. to be given the suitable advice in this regard. And Allah The Almighty Knows Best.

Is it permissible for a wife to boycott (not to attend to his different needs) her husband?

It isn`t permissible for the woman to boycott her husband unless he is the reason behind that, and it is recommended that both spouses seek the advice of righteous people to make reconciliation.

Is a woman`s neck an Awrah (private part)?

All Perfect Praise is due to The Lord of The Worlds.

It is an Awrah, and it is forbidden for her to reveal it before non-Mahrams (Marriageable men). And Allah Knows Best.

What is the ruling of Sharia when a woman leaves her house at one in the morning without husband`s consent?

Who has the right to child custody when final divorce takes place?

The wife has the right to child custody until her children reach the age of puberty. However, if she gets married, the right of custody becomes that of her mother`s.

Is it permissible to offer Salah (prayer) on behalf of the sick who is on his/her death bed, and is incapable of offering it?

It`s impermissible to offer Salah on behalf of the sick, or the dead.

What is permissible for the husband to do as far as having sex with his wife is concerned?

The couple are free to enjoy each other sexually provided that they don`t do it during menses. It is also forbidden for the husband to enjoy the wife from her anus.

How are gaps filled during congregational prayer?

A praying person is allowed to take two steps in order to fill the gap in the row ahead. If the distance was long and requires much movement, then it is impermissible for one to move to fill it because much consecutive movement (three movements) during prayer invalidates it.
