People`s Honor is inviolable

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions. Allah says {what means}: " Say: the things that my Lord hath indeed forbidden are: shameful deeds, whether open or secret; sins and trespasses against truth or reason; assigning of partners to God, for which He hath given no authority; and saying things about God of which ye have no knowledge." {Al-`Araf, 33}.

The Message of Islam delivered to humanity through Prophet Mohammad (PBUH) steers societies and civilizations to the straight path, spreads love and mercy, fights all forms of transgression and destruction from which Islam is innocent.

Amongst the higher objectives of Sharia (Maqasi) is preserving honor and lineage as well as building family on sound foundations according to the rules of true Sharia, which made marriage a permanent sacred contract and a solemn covenant to establish the family and protect it against transgression and corruption.

Islam considered violating the honor and property of Muslims as a grave sin that entails penalties in this life and the next, in addition to considering this an act of injustice to self and society. Indeed! Allah doesn`t love those who do wrong.

Part of the affliction that we are noticing nowadays is that some who claim to be scholars use social media to launch twisted calls that involve twisting Sharia texts and taking them out of their context to serve certain purposes that don`t lie in the best interest of the Muslim nation. Rather, they distort the luminous image of Islam, twist its noble objectives, and spread discord and dissension.

One of these corrupt calls is the call for establishing families without the valid marriage contract that adheres to the teachings of Sharia. This is knowing that Sharia presented family provisions in details to hinder the mischievous or the ignorant from tampering with them.

It is the duty of the Iftaa` Department to warn against the perverted views that are formulated in the shape of Fatwa. It stresses that these don`t represent the true nature of Fatwa nor the considerable opinions of the learned men of the faith. This is because they don`t rest on correct evidence, aren`t issued by the considerable and qualified scholars of Fatwa and they include rulings that are corrupt and contradict with the higher objectives of Sharia.

We pray that Allah bless this country with peace and security along with the rest of the Muslim countries.

Summarized Fatawaa

What is the ruling of Islamic Law on compensating the patient in case of medical error on the part of the treating physician?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.

The foundational principle is that every mistake issued by a physician that causes harm to another due to his negligence or lack of expertise obligates him to guarantee liability and compensate the harmed party. The Sharia maxim, in this regard, states: "The direct actor is liable."

Ibn Qudamah (may Allah have mercy on him) says: "As for if he was skilled but his hand committed an error—such as exceeding the proper limit of incision, cutting in an incorrect site, cutting with an instrument that inflicts excessive pain, or cutting at an unsuitable time—he is liable, because it is destruction (Itlaf) whose liability does not differ between intent and mistake, thus resembling the destruction of property; and because it is a prohibited act, so he guarantees liability for its secondary effects." [Al-Mughni].

However, if the physician performed what was necessary in the most complete manner and took all measures of care and caution, but complications occurred that could not be avoided according to specialists, then no liability rests upon him.

Shaykh al-Islam Imam al-Nawawi (may Allah have mercy on him) says: "The cupper and the circumciser bear no liability if they have not been negligent, and likewise the veterinarian if he bleeds an animal and it perishes." [Rawdat al-Talibin].

Al-Khattabi (may Allah have mercy on him) said: "I know of no disagreement that if the practitioner transgresses and the patient perishes, he is liable. Anyone who undertakes knowledge or practice he does not know is a transgressor; so if perishing arises from his action, he is liable for the blood-money (Diyah) while capital retaliation (Qisas) is dropped from him, because he did not act independently without the patient's permission. And the physician’s offense in the view of the generality of jurists is borne by his agnates ('Aqilah*)."* [Ma'alim al-Sunan].

If negligence or transgression is established against the physician, it is necessary to compensate the patient or seek forgiveness from him. And Allah Almighty knows best.

Is it permissible to offer an Udhiyah on behalf of another without their permission?

Praise be to Allah, and peace and blessings be upon our master, the Messenger of Allah.

It is not permissible for a person to offer a sacrifice (Udhiyah) on behalf of someone else without their permission, except in the following cases: if he sacrifices on behalf of the members of his household, if a guardian sacrifices from his own wealth on behalf of his ward, or if the Imam (ruler) sacrifices from the public treasury (Bayt al-Mal) on behalf of the Muslims. And Allah the Almighty knows best.

Is it permissible for a woman to perform the obligatory prayer immediately after the adhan and before the Iqamah is performed in the mosque?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

Yes, it is permissible for a woman to perform the obligatory (Fard) prayer immediately after the Adhan (call to prayer) and before the Iqamah (call to commence prayer) is performed in the mosque. And Allah the Exalted knows best.

Does the intention (niyyah) of the principal (muwakkil) suffice for the sacrifice (dhabḥ) of the udhiyyah?

Praise be to Allah, and peace and blessings upon our master, the Messenger of Allah.
If a person appoints an agent (wakīl) to perform the slaughter (dhabḥ) on their behalf, the intention (niyyah) of the principal (the one appointing the agent) suffices, and there is no need for the agent to have this intention himself. In fact, even if the agent is unaware that he is performing the sacrifice on someone's behalf as an udhiyyah (sacrificial offering), this does not affect its validity. And Allah, the Most High, knows best.
