Islamic Ruling on Begging

Begging is a hateful phenomenon that harms the reputation of society, disturbs and distorts its image, and makes the beggar look needy and humiliated. The Messenger of Allah (PBUH) forbade that a Muslim humiliates himself where he said: "It is not for the believer to humiliate himself." {Transmitted by Tirmithi}.

He (PBUH) warned against begging and discouraged such an act because a beggar loses face in this life and the hereafter. Bukhari and Muslim reported that the Messenger of Allah (PBUH) said: "When a man is always begging from people the result will be that he will come on the day of resurrection with no flesh on his face.”

Islam is keen on preserving human dignity and protecting it against humiliation and wretchedness, so we warn against begging, as it is incompatible with dignity that Allah The Almighty Has honored humans with as He, The Almighty Said (What means): "We have honoured the sons of Adam" {Al-Isra`/70}.

In addition, it is forbidden for the one who owns money that suffices their need or who is able to make a living to resort to begging, be that for money of Zakah, charity, or expiation, and it is forbidden to take it. Al-Shabramoulsi said: "If the beggar showed poverty and the giver thought that he was as such then what he was given isn`t his because he has tricked the giver who thought that he was poor. The proof of this is that the Messenger of Allah (PBUH) said: "He who begs to increase his riches is in fact asking only for a live coal. It is up to him to decrease it or increase it." [Muslim]. And he (PBUH) said: "When you ask (for anything), ask it from Allah, and if you seek help, seek help from Allah.” Accordingly, the one who practices this ugly profession eats up people`s wealth unjustly and feeds his children using ill-gotten money.

Young children and women sent by their guardians to beg at traffic lights and the doors of houses of worship distort the beautiful image of our blessed country. They even live on the streets barefooted, wear vulgar clothes, show destituteness and humiliation to turn people's emotions and deceive them to think that hunger drove them to do this.

Islam has tackled this abusive phenomenon by prohibiting begging, encouraging work and production, and making man`s best meal that which he has earned by working with his own hands. The Prophet (PBUH) said: "Nobody has ever eaten a better meal than that which one has earned by working with one's own hands, and the Prophet of Allah David (PBUH) used to eat from the earnings of his manual labor." {Bukhari}.

One who is needy should turn to the concerned authorities in our country. The beggar takes people's money unrightfully and will be held to account for that Before Almighty Allah on the Day of Judgment. The Jordanian law regards begging without a lawful excuse a crime for which a person deserves punishment because it is eating up people's wealth unjustly, in addition to being a means of deception. Moreover, people should stop giving beggars and the latter should be preached not to eat people's wealth unjustly. And Allah The Almighty Knows Best.

Summarized Fatawaa

What is the ruling of Islamic Law on a fictitious marriage for the purpose of obtaining citizenship?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
There is no such thing in our noble sharīʿah as a "nominal" or "fictitious" marriage or divorce. Marriage and divorce are among the sacred ordinances of Allah, and it is not permissible to manipulate them or use them as a stratagem to obtain worldly gains.
The foundational purpose of a marriage contract is the permanence and continuity of the relationship between the spouses — to establish a family, and to bring forth righteous offspring. So sacred is this bond that Allah the Almighty Himself described it as a solemn covenant (mīthāq ghalīẓ), saying {what means}: "And if you wish to replace one wife with another and you have given one of them a great amount of wealth, do not take any of it back. Would you take it in injustice and manifest sin? And how could you take it while you have gone in unto each other and they have taken from you a solemn covenant?" [Al-Nisāʾ/ 20–21]
Accordingly, it is not permissible to resort to manipulation and deception in contracts that Allah, Mighty and Majestic, has described as a "solemn covenant" — all for the sake of material and worldly benefit. Marriage is built upon permanence and does not admit of a fixed time limit. If a time limit is stipulated in the contract, the contract is rendered invalid by the consensus of the jurists. Similarly, marriage is impermissible when there exists a mutual, concealed intention to limit its duration — even if no time limit is explicitly mentioned in the contract — for this constitutes a form of unlawful circumvention of the sharīʿah. This is to say nothing of the lying and deception that such conduct involves, the prohibition of which needs no elaboration. Lying, deception, and fraud for the purpose of obtaining worldly gains are among the gravest of sins.
If, however, the marriage contract is first concluded in a valid sharʿī manner and then registered civilly, it is sound and fully valid. And Allah the Almighty knows best.

How is the beginning of Ramadan determined?

1. Completing 30 days of Sha‘ban, or
2. Sighting the crescent moon after sunset on the 29th day of Sha‘ban.
It is Sunnah to search for the moon, and it is obligatory to follow the official authorities responsible for announcing it.

What do you say about someone who stays up all night on Laylat al-Qadr but misses Fajr prayer?

Such a person has deprived themselves of a great reward. Performing obligatory acts is more beloved to Allah than voluntary acts. Fajr prayer is an obligation, and performing it in congregation is equivalent to worshiping for the entire night. So how can someone neglect it while striving for voluntary prayers?!

What is the ruling on the follower`s prayer if the Imam stands for a fifth rak`ah?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

If the Imam stands up for an extra unit (rak‘ah) of prayer out of forgetfulness, he must return to the sitting position as soon as he remembers, and he should perform the prostration of forgetfulness (Sujud al-Sahw). It is the duty of the congregants (Ma’mumin) behind him to remind him. However, if the Imam is in a state of doubt regarding the extra unit (and not certainty), it is not permissible for him to return.

As for the congregants: anyone who is certain that the Imam has stood for an extra unit is forbidden from following him. In this case, the follower has two choices: either intend to separate from the Imam (Mufaraqah) and finish the prayer alone, or wait for the Imam in the sitting position and perform the final salams with him—the latter being the preferred option. If a follower knowingly follows the Imam into an extra unit, their prayer becomes invalid. However, if a follower is in doubt and not certain of the mistake, they must continue following the Imam, as the Imam was appointed to be followed.

It is stated in Al-Majmu’ (Vol.4/P.145): 'If [the Imam] stands for a fifth rak‘ah, the follower should not follow him, even if it is assumed that the Imam might have omitted a pillar from a previous unit; because if the reality is known, following him is impermissible since the follower has certainly completed their own prayer. Even if the follower had missed a previous unit (Masbuq) or was in doubt about performing a pillar like the Fatihah, and the Imam stood for the fifth, it is not permissible for the latecomer to follow him in it. This is because we know that this unit is not counted for the Imam and that he is mistaken in performing it.' And Allah the Exalted knows best.
