The Fatwa Department of the Hashemite Kingdom of Jordan was founded in 1921. Since its formation, it has relied upon Hanafi fatwas which were in use during the Ottoman era, and the Mufti has answered the questions of members of the public, whether they relate to worship or financial transactions or personal statutes, and it has assigned a mufti to each judge in cities both large and small. Is a woman`s neck an Awrah (private part)?

All Perfect Praise is due to The Lord of The Worlds.

It is an Awrah, and it is forbidden for her to reveal it before non-Mahrams (Marriageable men). And Allah Knows Best.

Is it permissible for a woman to swear a false oath by the Holy Quran to please her distrustful husband?

It is forbidden for a person to do so since this is considered a false oath (Yamaan Ghamoos) which dips (Yaghmos) its taker in Hellfire if he/she doesn`t seek repentance, and he/she has to expiate for that oath. You should avoid any doubtful acts so that your husband`s chest remains clear from the evil suggestions of the devil.

Is it permissible for the heirs of the person who caused the accident (The Killer) to fast (The intended as an expiation for unintentional killing) on his behalf if the latter died in the crash?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

One who dies while liable for obligatory fast, his/her guardians have the choice to either fast on his/her behalf or feed one poor Muslim for each day of missed fast. This applies to Ramadan and other obligatory fast, and since expiatory fast is obligatory, feeding a poor person for each missed day or fasting on behalf of the deceased is obligatory as well. And Allah The Almighty Knows Best.

Is it permissible to make ablution without answering the call of nature after waking up?

Washing front and back openings (Istinjaa`) is not a condition for the validity of ablution because it is done to remove Najaasah (impurity), thus if there is no Najaasah, there is no need for that, and then it is permissible to make ablution without answering the call of nature. However, prayer is invalidated if there is Najaasah on the anus ,or the front opening, so it (Najaasah) must be removed for the prayer to become valid, and not the ablution.

The General Iftaa` Department celebrates along with all Jordanians the Anniversary of the Royal Accession to the Throne and takes pride in all the gains achieved since the founding of the kingdom until now. It takes this opportunity to congratulate His Majesty King Abdullah II on the twentieth anniversary of his accession to the throne. A woman didn't fufill fasting of the month of Ramadan two years ago, due to pregnancy and breastfeeding, at the time being she is making up the missed Ramadan. What is the ruling of Sharia? And what is due on her?

Whosoever break the fast during Ramadan or didn't fast at all due to health concerns, is obliged to make up the missed fasts whenever she could so long as making up missed Ramadan didn't extend to the coming one, and if next one arrived without fulling fasting the missed one, the ransom is 60 grams for each missed day (Equals 60 piasters to one Dinar for each day). And Allah The Almighty Knows Best.

Is it permissible to pay the expiation of an oath to a charitable party as it feeds the poor and needy such as Tkiyet Um Ali?

There is no harm on authorizing someone to handle the expiation of another to the poor and needy, since Shafiee's jurists stated that authorizing someone for the purpose of distributing Zakah, expiation and vow is permissible as stated in [Mughni Al-Muhtajj,vol.3/pp.237]. At last, the intention of the person who intends to authorize someone else suffices in this regard. And Allah Knows Best.

Is it permissible for the guardian to give Sadaqa (voluntary charity) from the money of the orphans?

It is impermissible for the guardian to donate from the money of the orphans because he is entrusted with the safekeeping of that money, and is prohibited from donating it.

If a father stops his daughter from getting married, is it permissible for her to conclude the marriage contract herself?

It is permissible for the father to stop his daughter from getting married if there was a lawful reason for that, and she isn`t allowed to conclude the marriage contract without her guardian. However, if her father denied her right in getting married for an unlawful reason, then she should go to court.
