In the Name of Allah, the Entirely Merciful, the Especially Merciful

Statement on the so-Called "Deal of the Century"

All perfect praise be to Allah the Lord of the Worlds. May His blessings and peace be upon Prophet Mohammad, all his kin and companions.

The General Iftaa` Department censures and rejects the so-called "Deal of the Century" and affirms that Jerusalem is the capital of Palestine and that the Hashemite custodianship over it is amongst the non-negotiable, religious and national principles. It also affirms the right of the Palestinians to live on their national territory and that none has the right to surrender a bit of sand from the land of Palestine. Jordan will continue to defend Jerusalem, its holy sites and the blessed land of Palestine, and this is the position of all Jordanians led by His Majesty King Abdullah II. Allah Says (What means): "And God hath full power and control over His affairs; but most among mankind know it not." [Yousef/21].

Summarized Fatawaa

What is the Islamic ruling on the Udhiyah (sacrificial offfering)?

Praise be to Allah, and peace and blessings be upon our Master, the Messenger of Allah.

The Udhiyah (sacrificial offering) is a Confirmed Sunnah (Sunnah Mu’akkadah) for every adult Muslim of sound mind who possesses the financial means, whether they are a resident, a traveler, or a pilgrim (Haj). This is based on the statement of the Prophet ﷺ: 'When the ten days [of Dhu al-Hijjah] begin and one of you desires to offer a sacrifice, let him not touch [cut] anything of his hair or skin' [Narrated by Muslim].

The point of evidence (Wajh al-Dalalah) here is that the Prophet ﷺ linked the sacrifice to the individual's will and desire by saying, 'and one of you desires.' This indicates that it is not obligatory (Wajib); had it been mandatory, he would have simply said, 'let him not touch his hair until he sacrifices' [without making it conditional upon desire].

Furthermore, it is narrated that Abu Bakr and Umar (may Allah be pleased with them both) would sometimes refrain from offering the sacrifice out of fear that people might mistakenly view it as an obligatory duty [Narrated by al-Bayhaqi and others with a good (Hasan) chain of transmission]. And Allah the Exalted knows best.

What is the ruling on the ablution of one from whom blood exits from his nose or a wound?

Blood flowing from a wound or a nosebleed does not invalidate ablution. However, performing ablution is recommended to avoid scholarly disagreement with those who make ablution obligatory after blood flows. And Allah the Almighty knows best.

What is the ruling of Islamic Law on shaving body hair and clipping the nails for one who is in a state of major ritual impurity (*junub*)?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah.
It is recommended for one in a state of major ritual impurity (junub) not to remove anything from his body until after the ritual bath (ghusl). It is stated in Bushrā al-Karīm bi-Sharḥ Masāʾil al-Taʿlīm (p. 135): “It is recommended for one in a state of janābah and the like not to remove anything from his body until after ghusl, because the parts of the body return to him in the Hereafter, and he returns in a state of janābah, as a rebuke to him. Then it is removed from him, except for the original parts. It is said that every hair demands its due for its janābah.”
It is stated in Ḥāshiyat al-Shabrāmallisī ʿalā Nihāyat al-Muḥtāj (Vol.2/p.341): “If he wishes to combine shaving and the Friday ghusl, he should delay the shaving until after the ghusl if he is in a state of janābah, so that the ghusl removes its trace from the hair.” And Allah Almighty knows best.

How to pay Zakah (obligatory charity) due on articles of merchandise?

Articles of merchandise are estimated by their whole sale market price at the end of each lunar year, and (2.5%) of their value is paid as Zakah whether it (value) went up, or down compared to actual purchasing price, and whether the increase (profit) was in the article itself such as an increase in the animal`s weight, or in the prices themselves. And Allah Knows Best.
