Question :

An employee of a certain company had an accident, which caused him a permanent disability. Although the accident took place on March 16nth, 2013, the company manager registered this employee with the Social Security on the 1st of March, 2013. Is it permissible for this employee to take the benefits of the Social Security?

The Answer :

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

Allah the Almighty has forbidden lying and fraud for He says (What means): " O ye who believe! Fear God and be with those who are true (in word and deed)." {At-Tawbah, 119}. Moreover, Abu Bakrah (May Allah be pleased with him) reported: "The Messenger of Allah (PBUH) said: "Shall I not inform you of one of the gravest of the cardinal sins?" We said: "Yes, O Messenger of Allah!" He (PBUH) said: "To join others as partners with Allah in worship and to be undutiful to one's parents." The Messenger of Allah (PBUH) sat up from his reclining position (in order to stress the importance of what he was going to say) and added: "I warn you making a false statement and giving a false testimony. I warn you against making a false statement and giving a false testimony." The Messenger of Allah (PBUH) kept on repeating this (warning) till we wished he should stop.

[Al- Bukhari and Muslim].

What the above manager did is an act of fraud, and this is neither permissible to commit nor help in. The evidence on this is that Allah the Almighty Says (What means): " Help ye one another in righteousness and piety, but help ye not one another in sin and rancour: fear Allah. for Allah is strict in punishment." {Al-Mai`dah, 2}.

One who wants to register with the Social Security Fund and receive its benefits must pay a portion of his salary to that Fund on regular basis to become entitled to a pension and other benefits when reaching a certain age. This is provided that the deduction starts from the same date of registering with the Social Security. This is since Allah the Almighty Says (What means): " Come not nigh to the orphan’s property except to improve it, until he attains the age of full strength; and fulfil (every) engagement, for (every) engagement will be enquired into (on the Day of Reckoning)." {Al-Isra`, 34}.
