Resolution No. (297) (17/2020), By The Board of Iftaa', Researches and Islamic Studies:

"Investing Land Endowed for Building a Mosque"

Date: (16th of Rabi'ul-Akhir, 1442 AH), corresponding to (2/12/2020 AD).

 

All perfect praise be to Allah, the Lord of the Worlds; may His blessings and peace be upon our Prophet Mohammad and upon all his family and companions.

In its 13nth meeting held on the above date, the Board of Iftaa` reviewed the letter No.4/2/2/10794 sent from His Excellency the Minister of Awqaf, Holy Sites and Islamic Affairs Dr.Mohammad Al-Khalayleh. It stated as follows: "We would like to bring to your attention that Mr.Yaghi has donated the land No. (586/5) (Al-Ar-Rafiah, An-nawaijees Village, of the lands of eastern Amman) for building a mosque. This land is estimated at (530) square meters and is registered in the name of the Ministry of Awqaf, Holy Sites and Islamic Affairs under a contract of hibah (gift)/2009. This land has been vacant since 2009, however, several mosques were built near it and they suffice for prayer performers residing in that area. However, this land is considered in violation of the regulations stated in the Jordanian Law in this regard. In addition, not benefitting from it defies the purpose for which it was endowed in the first place. Based on the aforementioned, what is the ruling of Sharia on investing this land?

After careful consideration, the Board has arrived at the following resolution :

It is permissible to invest the above land and use the revenue in favor of the surrounding mosques, and in a manner that achieves the purpose for which it was endowed. This is of course after the donor, or his heirs in case he was dead, approve of that. And Allah The Almighty Knows Best.

What does (Whoever fasts Ramadan with faith and seeking reward) mean?

This phrase is part of a hadith in which the Prophet ﷺ said:
"Whoever fasts Ramadan with faith and seeks his reward from Allah, their past sins will be forgiven." [Agreed upon]
The meaning is:
● They fast Ramadan with firm belief that Allah has made it obligatory.
● They fast out of obedience to Allah, knowing they will meet Him.
● They hope for reward from Allah and fast purely out of their faith while seeking His reward.

What should someone do whose gums are bleeding?

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.
Whoever experiences bleeding gums while fasting must spit until his saliva runs clear — that is, until the bleeding has stopped — and then rinse his mouth to purify it.
If any of the blood enters his internal cavity (jawf) unintentionally, then his fast remains valid. And Allah, the Exalted, knows best.

What is the ruling of Islamic Law on kissing while fasting?

All praise is due to Allah, and peace and blessings be upon our master the Messenger of Allah ﷺ.
It is prohibitively disliked (makrūh taḥrīman) for a husband to engage in foreplay with or kiss his wife during the daylight hours of Ramaḍān if doing so stirs his desire. If pre-seminal fluid (madhī) is released as a result, the fast is not invalidated; however, if seminal fluid (manī) is released, the fast is broken.
Imām al-Khaṭīb al-Sharbīnī, may Allah have mercy upon him, stated: "It is prohibitively disliked to kiss — whether on the mouth or elsewhere — for one whose desire is stirred, whether man or woman, to the extent that he fears it may lead to intercourse or ejaculation. Embracing, touching, and similar acts without a barrier carry the same ruling as kissing in this regard, because such acts expose the act of worship to being corrupted — and as the two Ṣaḥīḥs record: 'Whoever circles around a protected boundary is liable to fall into it.'"
He further added: "It is preferable for one whose desire is not stirred — even if he is a young man — to refrain from such acts as well, so as to close the door entirely. For he may believe his desire has not been aroused when in fact it has. Moreover, it is Sunnah for the fasting person to abstain from all desires without exception." — Summarised with minor adaptation from [Mughnī al-Muḥtāj]. And Allah the Almighty knows best.

Is the son of the sister by breastfeeding considered a mahram in Islam, and is it permissible for a woman to go for Hajj with him?

Everything that is prohibited by lineage is also prohibited by breastfeeding. The son of the sister by breastfeeding is considered a mahram, just like the son of the sister by blood, and it is permissible for him to be her mahram for Hajj and Umrah. And Allah Knows Best.
