Resolution No.(101) by the Board of Iftaa`, Research and Islamic Studies

 “Sharia Ruling on Lying in Sale”

Date: 4/4/1427 AH, corresponding to 3/5/2006 AD

 

 

 

 

Question:

 

Is it permissible for a trader to say that a certain item is made in Italy-for example-while it is either made in China, or made in China and shipped to Italy, or most of its parts are made in Italy and some of them are made in China?

Answer: 

The Board is of the view that a Muslim-whether a trader, a salesman, or whatever his work may be-must be truthful in all that he says and always tell the truth about each item that he promotes. It is forbidden for him to resort to lying and cheating under any circumstances. Prophet Mohammad (PBUH) said: “Truth leads to piety and piety leads to Jannah(Paradise). A man persists in speaking the truth till he is recorded with Allah as a truthful man. Falsehood leads to transgression and transgression leads to the Hell-fire. A man continues to speak falsehood till he is recorded with Allah as a great liar.“ {Bukhari & Muslim}. He also said: “He who deceives isn`t of us.“ {Muslim}. And he (PBUH) said: “A Muslim is the brother of a Muslim, so it is impermissible for a Muslim to sell a deficient item to his brother without mentioning that to him “ {Bukhari}. Is it permissible for a teacher to have one of the school meals originally allocated to students considering that there is plenty of them and they may spoil?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
The Ministry of Education has the final say in this regard because it isn`t allowed to take from public funds save with the permission of the body in charge of spending from it. In fact, we have sent a letter to the Ministry concerning this issue and we are waiting for an answer. However, to prevent spoilage of the meals, they can be sold and the price kept in favor of the students or distributed amongst the students themselves. And Allah The Almighty Knows Best.

Is it permissible for the doctor to uncover the hair of a female patient out of necessity?

It is only permissible for him to do so when there is no female doctor, and he should examine the patient in the presence of one of her Mahrams (unmarriageable kin).

Is it permissible for the wife to give the Zakah (obligatory charity) of her money to her poor husband?

Yes, it is permissible for the wife to give from the Zakah of her money to her poor husband. And Allah Knows Best.

There is a car dealership, and their method of selling is as follows: The customer pays the full price of the car, the car is registered in their name, and another contract is written in which the company commits to refunding the full price of the car to the customer after one year from the purchase date. What is the Islamic ruling on this transaction?

As for purchasing the car, paying its price, and owning it, this is a valid sale with no issue. However, the condition of refunding the price — whether the car is returned to the seller or not — is an invalid condition that nullifies the entire contract. Therefore, this transaction is invalid and not permissible. And Allah Knows Best.
