Subject : Islamic Ruling on Purchasing Bales (Clothes-Toys)

Question :

Bales of clothes and toys come in closely pressed packages. When customers want to buy such bales, the trader opens only one package as a sample, then the other packages are kept closed and are to be bought by the kilo? What is the Islamic ruling on this method of buying goods?



The Answer :

All perfect praise be to Allah the Lord of the Worlds. May Allah`s peace and blessings be upon our Prophet Mohammad and upon all his family and companions.

There is no sin in purchasing goods-which are difficult to count or can`t be counted because of their large number-wrapped in closely pressed packages by the kilo, even if the specifications of the items inside these packages differ. This is to make sales transactions easier for the people and observe customary practice to prevent dispute or conflict between sellers and buyers. Some scholars mentioned that piles of clothes were sold without indicating their number of specifications, if they were hard to open and count, paving the way for the customary practice of selling bales unless this led to dispute, and gambling. In conclusion, purchasing bales of clothes and toys is permissible when customary practice is observed and no uncertainty leading to dispute is involved. And Allah the Almighty knows best.
