Resolution No.(59): “Ruling on Planting Trees in Graveyards“

Date: 9/11/1422 AH corresponding to 23/1/2002 AD.

 

Question:

What is the ruling of Islamic Sharia on planting trees in graveyards?

Answer: All success is due to Allah.

According to Islamic Sharia, planting trees in graveyards is permissible since it is included within the general meaning of the Sharia maxim which states that, in principle, things are permissible so long as there is no provision from the Quran and the Sunnah proving otherwise, and there is no evidence that forbids such an act. However, trees shouldn`t be planted directly above the graves, rather, they should be planted in the corridors and places where there are no graves. This is in order for their roots not to harm the dead because doing so is forbidden as stated in the Prophet`s Hadith {what means}: "Breaking a deceased body’s bones is exactly like breaking them when he is alive.” {Related by Abu Dawud in accordance with the conditions of Muslim}. Is it allowed to shave my beard to join the army taking into consideration that I can`t find a job?

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallahu ‘alayhi wa sallam, is His slave and Messenger.

The army should be joined in preparation for Jihad (Fighting in the cause of Allah), so if Jihad contradicts with growing a beard then it is allowed to shave it. And Allah The Almighty Knows Best.  

An Arab young man had an illegitimate sexual relationship with a Christian American while she was staying in one of the Arab countries. After she returned to America, she told him that she had doubts that she was impregnated by him. It is worth pointing that it is hard for him to get a visa to the USA. What is the ruling of Sharia on this?

All perfect praise be to Allah the Lord of the Worlds. May His peace and blessings be upon our Prophet Mohammad and upon all his family and companions.
Zina (Adultery and extramarital relations) is one of the grave sins that incur the wrath of Allah if the adulterer didn`t make immediate repentance. However, the child isn`t attributed to the adulterer. Rather, he/she is attributed to the woman who got pregnant by him and, according to Sharia, it isn`t considered a legitimate child of the adulterer. And Allah The Almighty Knows Best.

Is it permissible for a woman who is in her confinement to fast upon seeing blood signs that are neither black, nor red ?

Brownish, reddish, and yellowish discharges are all considered confinement until there is no colored discharge which marks the end of confinement. Moreover, the aforesaid woman is prohibited from fasting until she attains ritual purity. And Allah Knows Best.

Is it permissible for a wife to boycott (not to attend to his different needs) her husband?

It isn`t permissible for the woman to boycott her husband unless he is the reason behind that, and it is recommended that both spouses seek the advice of righteous people to make reconciliation.
