Question :

I am an employee at a government services department. Following an official governmental decision, most transactions are now processed externally through third-party offices and individuals. Some of these offices—such as surveyors' offices and electronic transaction entry offices—have asked me to perform certain tasks for them in exchange for a commission. I process these electronic transactions from my home outside of official working hours, and I make electronic payments on behalf of citizens through my phone in return for a commission. What is the ruling of Islamic law (Sharī‘ah) regarding this matter.


The Answer :

All praise is due to Allah, and peace and blessings be upon our master, the Messenger of Allah ﷺ.


 


From an Islamic perspective, an employee is classified as an exclusive hired worker  for the entity employing him, and he possesses no entitlement to any compensation beyond what was contractually agreed upon with his employer—namely, his salary and standard benefits. It is impermissible for him to accept side commissions, as an employee occupies a position of trust (mu'taman), and it is unlawful for him to derive any financial gain outside the framework of that trust. This duty of trust dictates that he may benefit from his position only to the extent of what his employer—the hiring entity—pays him, pursuant to the word of Allah, the Exalted {which mean}: "Indeed, Allah commands you to render trusts to whom they are due." [an-Nisā'/58]


 


Accordingly, it is impermissible for an employee to obtain any personal benefit outside the scope of his position of trust. This responsibility requires that his financial gain remain limited to the compensation paid by his employer. Furthermore, it is unlawful for him to exploit his public office by directing citizens or clients toward specific external offices to the exclusion of others, as this compromises the principles of equal opportunity and fairness, and exposes him to both religious (Sharī‘ah) and legal liability. And Allah, the Exalted, knows best.
