Question :

What is the ruling of Sharia on registering an engineer at an engineering office to obtain more building permits than the number determined by the Jordanian Engineers Association? This is knowing that this engineer will receive a salary from this office without doing any actual work for it. What is the ruling of Sharia on this engineer`s end-of-service gratuity and certificate of expertise?


The Answer :

All perfect praise be to Allah the Lord of the Worlds. May Allah`s peace and blessings be upon our Prophet Mohammad and upon all his family and companions.


It isn`t permissible to rent or rent out an academic certificate for investment if the certificate owner doesn`t supervise the work at the engineering office and doesn`t adhere to the rules and regulations issued by the official bodies supervising the work of the engineering offices.


It is an obligation upon a Muslim to be true in word and deed since Almighty Allah says {What means}:" O ye who believe! Fear God and be with those who are true (in word and deed)." {At-Tawbah, 119}. This is in addition to taking the rules of engineering offices, which were drawn up to achieve common interest, into consideration. The Messenger of Allah (peace and blessings be upon him) said, "He who cheats us is none of us." {Muslim}.


Moreover, any mistake in the implementation of the engineering plans and projects renders the engineer liable before Allah and accountable to the laws.


Consequently, it isn`t permissible for the engineer who is falsely registered with an engineering office to claim a certificate of expertise or an end-of-service gratuity since these are granted to one who has done the actual work of the engineering office where he is registered. And Allah the Almighty knows best.
